This Privacy Policy explains our practices, defines our users’ (“you” or “your”) privacy options and describes how your information is collected and used by Always Best Care Senior Services and the ways in which you can limit our use of your information.

Scope of this Privacy Policy
This Privacy Policy covers Personal Information collected through the Always Best Care Senior Services digital properties to which this Privacy Policy is linked. It also covers information we obtain from you through our applications, software systems and social media pages, or otherwise as described in this Privacy Policy. For purposes of this Privacy Policy, we refer to these digital properties and access points as the Always Best Care “Platforms.”
This Privacy Policy generally does not apply to data controlled and processed by independently owned and operated Network franchisees. Any client health data that is “protected health information” subject to the Health Insurance Portability and Privacy Act (HIPAA) and its implementing regulations, or similar laws of the local jurisdiction, and must be requested directly from the appropriate franchise office.
“Personal Information” means data about an individual who can be identified from that data, or by combining it with other data. Personal Information is usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.

We are a team of caring and compassionate people working together to provide the best possible care for you and your loved ones. We consistently provided quality services to our clients and gather information from you so we can communicate with you and inform you of the broad range of senior services we offer. We also use the information automatically collected about you during your use of the Site to improve the effectiveness of our Sites, operations, mobile experience, or marketing efforts, to prevent fraud and theft, and otherwise to protect visitors to our Site and business.
What Information is Collected?
Types of Information
We collect Personal Information as described below. Franchisees may also collect this information, to which Always Best Care may have access solely for the purpose of maintaining its franchise systems, marketing, brand standards, and other franchisor activities. We also receive Personal Information from third party lead generators to whom you have given consent to share your interest and that information with us.
Always Best Care collects information you provide us through your communications between you and the Platforms, such as an inquiry about our services or opportunities to franchise with Always Best Care. Information collected includes information voluntarily provided by you and may include information such as your name, email address, phone number, and physical address, and the patient’s name, if different from your own. You may also disclose other Personal Information throughout the site that is automatically transmitted to us through your use of the site or through other information you provide to us when you contact us for any reason. The Platforms may also collect general information about your technology preferences (such as the type of browner used or the files requested). Additionally, we may collect information regarding the websites you visit and other information, as described in this Privacy Policy.

We do not collect or maintain “protected health information” through our Sites. Information Use and Sharing
Except with your consent, we will share your Personal Information with third parties only in the ways that are described in this Privacy Policy. We may use your information, for purposes indicated in the Categories of Sources of Personal Information and How We Use and Share that Information chart below, for purposes such as:

- Advertising/marketing franchise network goods & services or promote our brand;
- Coordinating and administering our social purpose mission;

Franchise Network

Guidelines for Children
Our Sites and Platforms are not designed for children. We do not specifically collect information from any person under the age of 16. We do not market our products or services to children. Franchise Communications
We may share information with our independently owned and operated franchisees. However, franchisees also collect their own information separately for their own business purposes. If you are a customer or employee of one of our franchisees and would no longer like to be contacted by one of our franchisees, please contact the franchisee that you interact with directly.
Franchisees
If you are accessing the Site as an independently owned and operated franchisee or as an employee or contractor of such franchisee, your access and use of the Site is also governed by the franchise agreement applicable to your business, which is incorporated by this reference.
Business Transfers
We may sell, transfer and/or disclose your Personal Information as part of a business divestiture, sale, merger, or acquisition of all or a part of our business. Privacy Rights for California Residents
California Civil Code § 1798.83 permits users that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please contact us via the Site. If you are a California resident, then the California Consumer Privacy Act or “CCPA,” provides you rights with regard to the Personal Information collected online or offline. Data Privacy Request Form
If you contact an independently owned and operated Always Best Care franchise office in the Network, you will be required to submit a request through one of the previous two options. California residents may also designate an authorized agent to exercise their rights. Any Personal Information collected from you in connection with verification of your request will be used solely for the purposes of verification.
Verification Process
To protect your privacy, we will verify your identity prior to responding to a request. When you submit your request, we will require:
- Your first and last name
- Your email
- Your country and state of residence
- Your phone number
- Your relationship to Always Best Care or the Network
- If connected to a specific franchise, the location of that franchise.
When we receive a request, you will first be required to confirm your request via email. We will seek to verify your identity by validating the information provided against our records. If you submit a right to know or right to delete Personal Information, you will receive an email from “On Behalf of Always Best Care” to which you must respond in order to verify your identity and access our response(s). If you request disclosure of specific pieces of Personal Information, we may call you to verify your request. In addition to matching at least three pieces of Personal Information, you provide with information we maintain and require a signed declaration, under penalty of perjury, that you are requesting your own Personal Information.
If an authorized agent is submitting on your behalf, we will require submission of information indicated on the request form, which includes either: 1) a written authorization, signed by you, that authorizes that agent to make the specific request on your behalf; or 2) a valid power of attorney.
We will respond to your request within 45 days, unless we notify you of a 45-day extension, or other period as required or permitted by regulation.

- The Right to Out-Out of Targeted Advertising. “Targeted advertising” means displaying advertisements to a consumer where the advertisement is selected based on personal data obtained from that consumer’s activities over time and across nonaffiliated websites or online applications to predict such consumer’s preferences or interests.
- The Right not to Receive Discriminatory Treatment. Businesses cannot discriminate or retaliate against you for exercising your privacy rights. The fact that you have elected to exercise these rights will have no adverse effect on the price and quality of Our Services.

Consumer Health Data Policy for Washington State Residents
This Washington Consumer Health Data Privacy Policy (“Policy”) applies to “Consumer Health Data” as defined by the Washington My Health My Data Act (“MHMD”) that is collected from you by Always Best Care Senior Services (“Always Best Care”, “we,” “us,” or “our”). This Policy supplements the Always Best Care Privacy Policy. In the event of a conflict between any other policy, statement, or notice and this Policy, this Policy will prevail as to Consumer Health Data Collected under MHMD.
Consumer Health Data under MHMD means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. This Policy does not apply where an exception or exemption applies such as for Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).
Consumer Health Data We Collect
The Consumer Health Data we collect depends on the context of your interactions with Always Best Care, the choices you make, the tools and features you use, your location, and applicable law. The following are examples of Consumer Health Data (if not excluded from MHMD as PHI or otherwise):
- Information about your health-related conditions, symptoms, status, diagnoses, testing, or treatments (including surgeries, procedures, medications, or other interventions);
- Measurements of bodily functions, vital signs, or characteristics, including genetic data and biometric information;
- Use or purchase of prescribed medication;
- Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies;
- Internet or Network Activity Information essential to running our website such as Internet Protocol (IP) address, Media Access Control (MAC) address, operating system and version, and Internet browser type and version which could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your or another person’s health; and
- Other information that may be used to infer or derive data related to the above or other health information.
As mentioned above, some categories of personal information are specifically excluded from MHMD when we collect it for medical care, research, and other Always Best Care operations. Examples of MHMD-excluded data we collect include:
- Personal data defined as Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”);
- Health care information collected, used, or disclosed in medical records (chapter 70.02 RCW);
- Substance Use Disorder Patient Records (42 C.F.R. Part 2);
- Personal data used or shared in research (45 C.F.R. Part 46 and 21 C.F.R. Parts 50 and 56)
- Information and documents created specifically for and collected and maintained for Always Best Care Quality Improvement;
- Information that is de-identified as defined in HIPAA and information derived from such de-identified data; and
- Information used only for public health activities and purposes and Limited Data Sets as described in HIPAA.
Sources of Consumer Health Data
Always Best Care does not collect your Consumer Health Data unless you voluntarily provide it to us. We collect personal information, including Consumer Health Data, from the following categories of sources:
- Directly from you when you use our Services or Platforms, participate in a research study or clinical trial, attend Always Best Care programs or events, engage with customer service, and any other way that you may be able to interact with us. With your permission, we may also collect Consumer Health Data from another source provided by you, like your connected device or profile.
- From third-party sources including Always Best Care affiliates and franchisees, other medical providers, contracted service providers, and business associates as defined under HIPAA. We may engage third-party service providers to provide certain interactive features. By using these features, you understand that our vendors may process the information obtained through the feature to provide the Services on our behalf.
- From websites and mobile applications and automatically from devices you use to connect to our Services. For more information about this, please see our Privacy Policy and Terms of Use.
- We could collect information that includes Consumer Health Data if you voluntarily provided it in an open text field not related to medical care or research, such as the “leave a comment” box on our website or on a form.
Use of Your Consumer Health Data
Always Best Care are specifically excluded from MHMD. Those other uses of personal data collected by Always Best Care are described where those data are collected, including in our Privacy Policy and Terms of Use and other privacy notices and terms that provide disclosures about Personal Information.
To the extent we collect Consumer Health Data, we may use it for the following purposes:
- Providing you with health-related services you have requested or authorized;
- Delivering the Services and their features;
- Ensuring reliable operation of the Services and Platforms, including troubleshooting and improvements;
- Performing essential business operations to support our Services such as analyzing our performance, meeting our legal obligations, developing our workforce, and conducting research and development; and
- Other purposes for which we give you choices or obtain your consent as required by law – for example, for advertising or marketing purposes.
Always Best Care does not use any Consumer Health Data that may be voluntarily provided through an open text field not related to medical care, research or the Services without your express consent.
Sharing Consumer Health Data With Third Parties
Always Best Care will only share your Consumer Health Data with employees and trusted partners and only for provision of the Services to you. All such third parties are prohibited from using your Consumer Health Data except to provide these services to Always Best Care and they are required to maintain the confidentiality of your Consumer Health Data.
As necessary for the purposes described above, we may share personal information, including Consumer Health Data, with following categories of third parties:
- Affiliates. We enable access to data across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business.
- Service Providers. Vendors or agents (“processors”) working on our behalf may access Consumer Health Data for the purposes described above.
- Business Partners. We may share Consumer Health Data with other companies, for example, where you use a service that is cobranded and jointly operated with another company, or where you use our Services to interact with another company.

MHMD provides certain rights with respect to Consumer Health Data, including the right to access, delete, or withdraw consent relating to your consumer health data, subject to certain exceptions. Canadian residents should use our Canadian website at https://www.alwaysbestcarecanada.ca/ This Privacy Policy provides you with additional details of how we collect, use and disclose personal information (“Personal Data”) of Canadian residents (“you”). The types of Personal Data collected and the purposes for its collection, use and disclosure are as outlined in the main Privacy Policy.
Scope
This Privacy Policy covers Personal Data collected by Always Best Care Senior Services or any such information collected by one of its independently owned and operated Network franchisees located in Canada and shared with us. It does not cover Personal Data collected by a Canadian franchisee that is not shared with us. You should review the Privacy Policy of that franchisee and contact the franchisee with any questions regarding the Personal Data it has collected.
Types and Manner of Personal Data Collection
We may collect Personal Data in many forms (for example, hard/soft copy, electronically, facsimile, telephone conversations/recordings, email, etc.), but will only do so by lawful means and only for necessary purposes that have been disclosed to you, are described in our Privacy Policy, or are permitted or required by applicable law. In addition to the Types of Information listed in our US Privacy Policy, we may collect Personal Data that you provide to us via our interactions with you when you contact us by telephone, email or otherwise about our Services.
