ABCSP, LLC is a California Limited Liability Company that does business as “Always Best Care Senior Services” or “Always Best Care” (“we,” “us,” “our”). Always Best Care Senior Services consists of ABCSP, plus our parent company ABCSS Holdings, LLC, a Delaware Limited Liability Company, and serves as franchisor to the independently owned and operated Always Best Care Senior Services franchisee businesses (“Network”).  This Privacy Policy explains our practices, defines our users’ (“you” or “your”) privacy options and describes how your information is collected and used by Always Best Care Senior Services and the ways in which you can limit our use of your information.

This Privacy Policy and our  Terms of Use govern your use of the Always Best Care websites at https://www.alwaysbestcare.comhttp://www.franchisewithalwaysbestcare.com, and   https://www.alwaysbestcarecanada.ca/   (“Sites”). By using the Always Best Care websites or any of our applications, products, services, features, tools, or resources linked to this Privacy Policy, you agree to its terms. Scope of this Privacy Policy

This Privacy Policy covers Personal Information collected through the Always Best Care Senior Services digital properties to which this Privacy Policy is linked.  It also covers information we obtain from you through our applications, software systems and social media pages, or otherwise as described in this Privacy Policy. For purposes of this Privacy Policy, we refer to these digital properties and access points as the Always Best Care “Platforms.”

This Privacy Policy generally does not apply to data controlled and processed by independently owned and operated Network franchisees.  Any client health data that is “protected health information” subject to the Health Insurance Portability and Privacy Act (HIPAA) and its implementing regulations, or similar laws of the local jurisdiction, and must be requested directly from the appropriate franchise office.

“Personal Information” means data about an individual who can be identified from that data, or by combining it with other data. Personal Information is usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.

This Privacy Policy may be updated by Always Best Care from time to time and new versions will be marked with a corresponding effective date. Your continued use of the Platforms constitutes your agreement to our then-current Privacy Policy.

Why do we gather information?

We are a team of caring and compassionate people working together to provide the best possible care for you and your loved ones.  We consistently provided quality services to our clients and gather information from you so we can communicate with you and inform you of the broad range of senior services we offer.  We also use the information automatically collected about you during your use of the Site to improve the effectiveness of our Sites, operations, mobile experience, or marketing efforts, to prevent fraud and theft, and otherwise to protect visitors to our Site and business.

What Information is Collected?

Types of Information

We collect Personal Information as described below. Franchisees may also collect this information, to which Always Best Care may have access solely for the purpose of maintaining its franchise systems, marketing, brand standards, and other franchisor activities. We also receive Personal Information from third party lead generators to whom you have given consent to share your interest and that information with us.

Always Best Care collects information you provide us through your communications between you and the Platforms, such as an inquiry about our services or opportunities to franchise with Always Best Care. Information collected includes information voluntarily provided by you and may include information such as your name, email address, phone number, and physical address, and the patient’s name, if different from your own. You may also disclose other Personal Information throughout the site that is automatically transmitted to us through your use of the site or through other information you provide to us when you contact us for any reason. The Platforms may also collect general information about your technology preferences (such as the type of browner used or the files requested). Additionally, we may collect information regarding the websites you visit and other information, as described in this Privacy Policy.

Personal Information

Personal information may include the following:

  • Contact information, such as name, phone number, email address or physical address;
  • Information regarding interest in non-medical in-home care, assisted living referral services or skilled home health care;
  • General financial information such as credit score, approximate net worth or the amount of capital available to invest in a business;
  • Information regarding interest in looking to open a business;
  • IP address and browser information to measure our website traffic, personalize your experience and permit you to use our Sites;
  • “Cookies” and other tracking mechanisms which allow us to recognize you during use and navigation of the Sites.

How is Personal Information Used?

We maintain your Personal Information to provide you with information you have requested, to contact you in response to your inquiries, and for a variety of purposes including but not limited to:

  • Providing information regarding Always Best Care and future offers and services;
  • Using certain online preferences in the aggregate across all users to evaluate the Platforms and develop additional services to offer;
  • Sending or initiating direct marketing programs, such as newsletters or information about new services we are offering; and
  • Using content from social media platforms where you discuss our products or use a hashtag related to our products.

We do not collect or maintain “protected health information” through our Sites.  The term “protected health information” is described in the Notices of Privacy Practices in use by franchisees that are covered entities under HIPAA.  Any protected health information is governed by HIPAA and subject to franchisee’s Notice of Privacy Practices.  Each franchisee that is a covered entity is independently owned and operated. Information Use and Sharing

Except with your consent, we will share your Personal Information with third parties only in the ways that are described in this Privacy Policy. We may use your information, for purposes indicated in the Categories of Sources of Personal Information and How We Use and Share that Information chart below, for purposes such as:

  1. Advertising employment/recruitment;
  2. Advertising/marketing franchise network goods & services or promote our brand;
  3. Coordinating and administering our social purpose mission;
  4. Employee/Franchise client lead management;
  5. Communicating with you;
  6. Verifying your identity;
  7. Performing our contractual duties and obligations;
  8. Providing educational resources/learning management;
  9. Qualifying Prospective Franchise Owners/Master Franchise Principals;
  10. Participating in scientific/health Research;
  11. Obtaining payment;

In certain instances, you will have an opportunity to limit our uses at the time your Personal Information is collected or after by adjusting your account preferences. We will retain and use your information for as long as your account is active, or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We may share this information with service providers and sub-processors, involving onward transfer to help us and our Network provider to provide the Network’s respective services to you, as detailed below.

Communication

We, or our affiliates, may use your Personal Information to communicate with you, such as following up on your interest in receiving our Network’s services, other services described on our Site, and/or if you express interest in potential employment with us.

Our franchisees and affiliates may use your Personal Information to communicate with you, such as following up on your interest in receiving services and/or if you express interest in potential employment by our franchisees.

Franchise Network

We may share your Personal Information with our independently owned and operated franchisees and affiliates who are bound to protect such information from disclosure or misuse.

Service Providers

We may also share or disclose Personal Information to service providers to help us or the Network with our/its business activities, such as: offering customer service; assessing quality and customer satisfaction; enabling website features; providing research or analytics; developing advertising and marketing; providing enhanced care technology and services; or assisting with hiring of employees. These companies are generally subject to contractual restrictions on the use and retention of data, prohibited from selling your Personal Information, and authorized to use your Personal Information only as necessary to provide these services. Transfers to subsequent third parties are covered by the provisions in this Privacy Policy regarding Your Data Privacy Choices, and the franchise agreements with our franchisees.

How is Personal Information Shared and Protected?

We may share information, in the aggregate, regarding your online browsing preferences to evaluate our products or allow third parties we work with to better serve our users. We will not share Personal Information in these instances, other than described in this Privacy Policy.

Our employees and agents may view your Personal Information to perform their jobs and service your needs. We authorize their access to your Personal Information on a need-to-know basis to provide you with our products or services, or for one of the other reasons listed in this Privacy Policy.

We may provide your information to third-party service providers, third-party business partners or vendors for purposes of, including without limitation, data tracking, maintenance or development of our Sites and the Platforms, development of online products and services or customer service, or other contracted services provided to you. We may share this information with any subsidiaries, licensees, franchisees, affiliates, assigns, successors, or other respective owners.

We may release your Personal Information to others (including law enforcement) if we believe such release is reasonably necessary (i) to comply with a government or law enforcement request or judicial process; (ii) to operate this Site; (iii) to process any orders or registrations; (iv) to conduct any promotions, contests, or sweepstakes in which you participate; or (v) to protect the rights or property of the Company, its Affiliates, users, customers, recipients, Sponsors, Providers, Licensors, or Merchants (as such terms are defined in our Terms of Use. In addition, we may share aggregate, non-individual information, incapable of identifying a particular person, with third parties for lawful purposes.

We do not share any Personal Information regarding your approximate net worth or capital for investing and do not share your information with any third parties for the purposes of marketing any products or services not related to Always Best Care.

We do not sell any Personal Information to marketing research or bulk advertising sales companies. We may share your Personal Information with third parties, such as our service providers, but not in exchange for financial payment.

Guidelines for Children

Our Sites and Platforms are not designed for children. We do not specifically collect information from any person under the age of 16. We do not market our products or services to children. We have no reason to believe that our Sites will attract children or that children will access our Sites or provide personal information. If you believe your child has shared information with us, please notify us immediately so we can address the issue.

What information is automatically collected from our Site visitors?

When you visit our Site, certain non-personal information is collected, such as IP address, device ID, browser setting, operating system, referring domain, language preferences, mobile carrier, website activity and cookies. A “cookie” is a small file stored on your computer by a website which gives you a numeric user ID and stores certain information about your activity on the website. Apart from cookies, when you engage in a transaction with us or click on certain features, we will use a hashing algorithm that protects your personal information before we send it to Google for analytics and matching purposes. There are “do not track” or similar browser choices available to internet users with respect to online web activity but given the present lack of consensus of what constitutes an informed election, appropriate trigger or breadth of scope of such choice, our Site will not operate any differently when a “do not track” signal is received.

Independently owned and operated franchise businesses may also utilize such technologies on the Site dedicated to their specific franchise.  The franchise business is the controller of any such data collection and Always Best Care does not directly receive such data.  Each franchise business is responsible for its data collection, use and disclosure; however, collection via the Site is subject to the terms and limitations of this Privacy Policy.

Third Party Links

Our Platforms may contain links to other websites which have their own privacy policies that govern how they collect and use your personal information. The Platforms may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media websites is governed by the Terms of Use and Privacy Policy of the particular platform. We are not responsible for these third-party websites.

Your Data Privacy Choices

Franchise Communications

We may share information with our independently owned and operated franchisees. However, franchisees also collect their own information separately for their own business purposes. If you are a customer or employee of one of our franchisees and would no longer like to be contacted by one of our franchisees, please contact the franchisee that you interact with directly.

Franchisees

If you are accessing the Site as an independently owned and operated franchisee or as an employee or contractor of such franchisee, your access and use of the Site is also governed by the franchise agreement applicable to your business, which is incorporated by this reference.

Business Transfers

We may sell, transfer and/or disclose your Personal Information as part of a business divestiture, sale, merger, or acquisition of all or a part of our business. If another company acquires our company, business, or assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy. In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset. Any third party to which Always Best Care transfers or sells its company ownership or related assets will have the right to continue to use your Personal Information and other information that you provide to us.

We will not keep your Personal Information for any longer than is necessary for the purposes we collected it. Any Password for our Site or app will be the exclusive property and confidential information of the Company and may be used by you solely for your individual use of this Site. You are responsible for maintaining the confidentiality of any Password. All activities that occur using your Password are your responsibility, whether you authorized them or not. Privacy Rights for California Residents

California Civil Code § 1798.83 permits users that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please contact us via the Site. If you are a California resident, then the California Consumer Privacy Act or “CCPA,” provides you rights with regard to the Personal Information collected online or offline. This section of the Privacy Policy applies to California Resident Personal Information collected online or offline either: by Always Best Care; or by the Network and for which Always Best Care jointly determines the purposes and means of processing.

If you are a California resident, then by communicating or doing business with us, online or offline, you agree to the terms of the Privacy Policy in effect at that time and as may be updated from time to time.

We will not disclose certain sensitive information in response to a request, including your social security number, driver’s license number or other government-issued identification number, financial account number, your health insurance or medical identification number, your account password, security questions and answers, or unique biometric data generated from measurements or technical analysis of human characteristics. We will, however, inform you if we have collected such information and identify the type of information with sufficient particularity.

The CCPA does not apply to data protected under certain federal and state laws. For example, it does not apply to:

  • HIPAA protected health information collected by a covered entity or business associate;
  • Data of franchisees that are Covered Entities subject to HIPAA, to the extent the entity maintains the information in the same manner as protected health information;
  • Receipt and use of consumer reports (i.e. background checks) by an employer in accordance with the Fair Credit Reporting Act.

The CCPA also has a limited application to financial data subject to the Gramm-Leach-Bliley Act or state motor vehicle records subject to the Driver’s Privacy Protection Act of 1994.

These rights are not absolute and in certain cases are subject to conditions or limitations as specified in the CCPA. We will not unlawfully discriminate against you because you exercised any of your rights under the CCPA.

You have the right to request the deletion of your Personal Information we have collected from you. This right may be subject to certain conditions and limitations under the law.

Data Privacy Request Form

If you contact an independently owned and operated Always Best Care franchise office in the Network, you will be required to submit a request through one of the previous two options. California residents may also designate an authorized agent to exercise their rights. Any Personal Information collected from you in connection with verification of your request will be used solely for the purposes of verification.

Verification Process

To protect your privacy, we will verify your identity prior to responding to a request. When you submit your request, we will require:

  • Your first and last name
  • Your email
  • Your country and state of residence
  • Your phone number
  • Your relationship to Always Best Care or the Network
  • If connected to a specific franchise, the location of that franchise.

When we receive a request, you will first be required to confirm your request via email. We will seek to verify your identity by validating the information provided against our records. If you submit a right to know or right to delete Personal Information, you will receive an email from “On Behalf of Always Best Care” to which you must respond in order to verify your identity and access our response(s). If you request disclosure of specific pieces of Personal Information, we may call you to verify your request. In addition to matching at least three pieces of Personal Information, you provide with information we maintain and require a signed declaration, under penalty of perjury, that you are requesting your own Personal Information.

If an authorized agent is submitting on your behalf, we will require submission of information indicated on the request form, which includes either: 1) a written authorization, signed by you, that authorizes that agent to make the specific request on your behalf; or 2) a valid power of attorney.

We will respond to your request within 45 days, unless we notify you of a 45-day extension, or other period as required or permitted by regulation.

Privacy Rights for Nevada Residents

Nevada residents have the right to request that a company not sell their personal information. This right applies even if their Personal Information is not currently being sold. Privacy Rights for Colorado, Connecticut & Virginia Residents

As a resident of these states, your rights as a consumer include:

  • The Right to Know and Access.  You have the right to request to know and access the categories and specific pieces of personal information (also called “personal data”) we have collected about you.
  • The Right to Correct.  You have the right to request that we amend or update your personal information where it is inaccurate or incomplete.
  • The Right to Delete.  You have the right to request that we delete any personal information we have collected about you.  We will delete your personal information if we have no other no other legal ground or purpose to retain it.
  • The Right to Opt-Out of Sale.  We do not “sell” your information as the word “sell” is defined by the Virginia Consumer Data Protection Act. The Colorado and Connecticut privacy laws broadly define a “sale” to include as any sharing of personal information with third parties in exchange for monetary or other valuable consideration.
  • The Right to Out-Out of Targeted Advertising. “Targeted advertising” means displaying advertisements to a consumer where the advertisement is selected based on personal data obtained from that consumer’s activities over time and across nonaffiliated websites or online applications to predict such consumer’s preferences or interests.
  • The Right not to Receive Discriminatory Treatment.  Businesses cannot discriminate or retaliate against you for exercising your privacy rights.  The fact that you have elected to exercise these rights will have no adverse effect on the price and quality of Our Services.
  • Right to Appeal.  if we decline to take action in any privacy request that you submit in connection with the rights described in this Section, you may ask that we reconsider our response by sending an email to [email protected] (with “Privacy” in the subject line). You must ask us to reconsider our decision within 45 days after we send you our decision.

We do not create consumer profiles or automate decisions that produce legal or similarly significant effects concerning a consumer, which means a decision that results in the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunity, criminal justice, employment opportunities, health-care services or access to essential goods or services.

Consumer Health Data Policy for Washington State Residents

This Washington Consumer Health Data Privacy Policy (“Policy”) applies to “Consumer Health Data” as defined by the Washington My Health My Data Act (“MHMD”) that is collected from you by Always Best Care Senior Services (“Always Best Care”, “we,” “us,” or “our”). This Policy supplements the Always Best Care Privacy Policy. In the event of a conflict between any other policy, statement, or notice and this Policy, this Policy will prevail as to Consumer Health Data Collected under MHMD.

Consumer Health Data under MHMD means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. This Policy does not apply where an exception or exemption applies such as for Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).

Consumer Health Data We Collect

The Consumer Health Data we collect depends on the context of your interactions with Always Best Care, the choices you make, the tools and features you use, your location, and applicable law. The following are examples of Consumer Health Data (if not excluded from MHMD as PHI or otherwise):

  1. Information about your health-related conditions, symptoms, status, diagnoses, testing, or treatments (including surgeries, procedures, medications, or other interventions);
  2. Measurements of bodily functions, vital signs, or characteristics, including genetic data and biometric information;
  3. Use or purchase of prescribed medication;
  4. Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies;
  5. Internet or Network Activity Information essential to running our website such as Internet Protocol (IP) address, Media Access Control (MAC) address, operating system and version, and Internet browser type and version which could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your or another person’s health; and
  6. Other information that may be used to infer or derive data related to the above or other health information.

As mentioned above, some categories of personal information are specifically excluded from MHMD when we collect it for medical care, research, and other Always Best Care operations. Examples of MHMD-excluded data we collect include:

  • Personal data defined as Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”);
  • Health care information collected, used, or disclosed in medical records (chapter 70.02 RCW);
  • Substance Use Disorder Patient Records (42 C.F.R. Part 2);
  • Personal data used or shared in research (45 C.F.R. Part 46 and 21 C.F.R. Parts 50 and 56)
  • Information and documents created specifically for and collected and maintained for Always Best Care Quality Improvement;
  • Information that is de-identified as defined in HIPAA and information derived from such de-identified data; and
  • Information used only for public health activities and purposes and Limited Data Sets as described in HIPAA.

Sources of Consumer Health Data 

Always Best Care does not collect your Consumer Health Data unless you voluntarily provide it to us. We collect personal information, including Consumer Health Data, from the following categories of sources:

  • Directly from you when you use our Services or Platforms, participate in a research study or clinical trial, attend Always Best Care programs or events, engage with customer service, and any other way that you may be able to interact with us. With your permission, we may also collect Consumer Health Data from another source provided by you, like your connected device or profile.
  • From third-party sources including Always Best Care affiliates and franchisees, other medical providers, contracted service providers, and business associates as defined under HIPAA. We may engage third-party service providers to provide certain interactive features. By using these features, you understand that our vendors may process the information obtained through the feature to provide the Services on our behalf.
  • From websites and mobile applications and automatically from devices you use to connect to our Services. For more information about this, please see our Privacy Policy and Terms of Use.
  • We could collect information that includes Consumer Health Data if you voluntarily provided it in an open text field not related to medical care or research, such as the “leave a comment” box on our website or on a form.

Use of Your Consumer Health Data 

Always Best Care are specifically excluded from MHMD. Those other uses of personal data collected by Always Best Care are described where those data are collected, including in our Privacy Policy and Terms of Use and other privacy notices and terms that provide disclosures about Personal Information.

To the extent we collect Consumer Health Data, we may use it for the following purposes:

  • Providing you with health-related services you have requested or authorized;
  • Delivering the Services and their features;
  • Ensuring reliable operation of the Services and Platforms, including troubleshooting and improvements;
  • Performing essential business operations to support our Services such as analyzing our performance, meeting our legal obligations, developing our workforce, and conducting research and development; and
  • Other purposes for which we give you choices or obtain your consent as required by law – for example, for advertising or marketing purposes.

Always Best Care does not use any Consumer Health Data that may be voluntarily provided through an open text field not related to medical care, research or the Services without your express consent.

Sharing Consumer Health Data With Third Parties 

Always Best Care will only share your Consumer Health Data with employees and trusted partners and only for provision of the Services to you. All such third parties are prohibited from using your Consumer Health Data except to provide these services to Always Best Care and they are required to maintain the confidentiality of your Consumer Health Data.

As necessary for the purposes described above, we may share personal information, including Consumer Health Data, with following categories of third parties:

  • Affiliates. We enable access to data across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business.
  • Service Providers. Vendors or agents (“processors”) working on our behalf may access Consumer Health Data for the purposes described above.
  • Business Partners. We may share Consumer Health Data with other companies, for example, where you use a service that is cobranded and jointly operated with another company, or where you use our Services to interact with another company.
  • Financial Institutions & Payment processors. When you make a purchase or enter into a financial transaction, we will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
  • Government Agencies. We disclose data to law enforcement or other government agencies when we believe doing so is necessary to comply with applicable law or respond to valid legal process.

How to Exercise Your Rights 

MHMD provides certain rights with respect to Consumer Health Data, including the right to access, delete, or withdraw consent relating to your consumer health data, subject to certain exceptions. The written request should include sufficient information to verify your identity and specify the right you wish to exercise. Privacy Rights for Canadian Residents

Canadian residents should use our Canadian website at https://www.alwaysbestcarecanada.ca/ This Privacy Policy provides you with additional details of how we collect, use and disclose personal information (“Personal Data”) of Canadian residents (“you”).  The types of Personal Data collected and the purposes for its collection, use and disclosure are as outlined in the main Privacy Policy.

Scope

This Privacy Policy covers Personal Data collected by Always Best Care Senior Services or any such information collected by one of its independently owned and operated Network franchisees located in Canada and shared with us. It does not cover Personal Data collected by a Canadian franchisee that is not shared with us. You should review the Privacy Policy of that franchisee and contact the franchisee with any questions regarding the Personal Data it has collected.

Types and Manner of Personal Data Collection

We may collect Personal Data in many forms (for example, hard/soft copy, electronically, facsimile, telephone conversations/recordings, email, etc.), but will only do so by lawful means and only for necessary purposes that have been disclosed to you, are described in our Privacy Policy, or are permitted or required by applicable law. In addition to the Types of Information listed in our US Privacy Policy, we may collect Personal Data that you provide to us via our interactions with you when you contact us by telephone, email or otherwise about our Services. Certain types of Personal Data may be considered “sensitive” depending on the context.  When we collect sensitive Personal Data from you, we will obtain your consent as required by applicable laws at the time of collection.

Consent 

Your provision of Personal Data to us means that you agree and consent to our collection, use and disclosure of your Personal Data under this Privacy Policy. If you do not agree with this Policy, do not provide any Personal Data to us. Any client health data that is “personal health information” subject to the Ontario Personal Health Information Protection Act (PHIPA), the Alberta Health Information Act (HIA), or other similar provincial health information laws must be requested directly from the appropriate franchise office.

Any marketing email messages sent to you will give you the opportunity to update your contact details and mailing list preferences or unsubscribe from our mailing lists altogether. Please note that we are separate entities from our Canadian franchisees and operate separate mailing lists.
