Iowa trucking owner sentenced in $1.4M payroll tax scheme

The owner of an Iowa trucking company was sentenced to 21 months in federal prison for his role in a seven-year, $1.4 million payroll tax scheme.Mark Warm, 57, of Jesup, Iowa, the former owner of Warm Trucking Inc. The owner of an Iowa trucking company was sentenced to 21 months in federal prison for his role in a seven-year, $1.4 million payroll tax scheme.

Mark Warm, 57, of Jesup, Iowa, the former owner of Warm Trucking Inc. (WTI), was sentenced Thursday in the U.S. District Court for the Northern District of Iowa after pleading guilty in September 2021 to one count of willful failure to pay employment taxes to the IRS.

Once released from prison, Warm will serve three years of supervised release and has been ordered to pay more than $1.4 million in restitution to the IRS. No date has been set for when Warm must surrender to the U.S. Marshals Service.

According to court documents, Warm stated that he handled WTI’s finances. Warm admitted that from 2013 through 2019, he was responsible for withholding income taxes and Federal Insurance Contributions Act (FICA) taxes from the pay of his trucking company employees and that part of his job was to forward those withholdings to the IRS.

In his plea agreement, Warm admitted that he failed to forward to the IRS the money he withheld from his employees’ pay over a seven-year period, despite knowing he was required to do so.

About WTI, now 16 Trucking

Federal Motor Carrier Safety Administration data shows that WTI had 24 drivers, 40 power units and 45 leased trailers in January 2020, but those numbers dropped down to only one driver and one truck nine months later.

The trucking company also changed its name from WTI to 16 Trucking Inc. in November 2020 but was using the same DOT number and physical address in Jesup. Mark’s wife, Mikki Warm, is listed as the contact for the new company, 16 Trucking, which only has one driver and a single power unit, according to FMCSA’s SAFER website.

“Mr. Warm’s failure to pay employment taxes for seven years was an attempt to dodge his obligations to his employees and to the United States,” U.S. Attorney Sean Berry said in a statement.

State regulators ordered a northeast Iowa grain dealer to stop buying large amounts of grain after it failed to pay for an unspecified amount of grain, among other violations of its licenses.

The Iowa Department of Agriculture and Land Stewardship announced Friday it suspended the grain dealer and warehouse licenses of B&B Farm Store in Jesup, just east of Waterloo.

"The suspension is based upon the company's failure to pay for priced grain, grain shortage and record keeping violations," IDALS said.

Don McDowell, a spokesman for the department, declined to elaborate on those allegations because IDALS has requested an administrative law hearing about the matter. Such hearings can result in financial penalties for grain dealers.

Generally, dealers that buy at least 1,000 bushels of grain per month are licensed and regulated by the state to help protect grain producers from losses. Dealers are required to have sufficient assets to cover their debts for grain purchases, and those that don't can have their licenses suspended.

District court records show that Farmers State Bank filed last week for foreclosure against B&B and an associated company, J&D Investors, seeking more than $4.6 million in unpaid debts. The businesses avoided foreclosure early this year through mediation but have since failed to make payments that were stipulated by that mediated agreement, according to the bank's recent foreclosure petition. Court records did not indicate any other pending litigation against B&B.

The state maintains an indemnity fund that covers up to $300,000 worth of losses incurred by individual producers who sell grain to state-licensed dealers but aren't paid.

B&B Farm Store declined to comment for this article. It's unclear when the administrative law hearing will be held.

The business sells outdoor equipment and supplies, and it also operates a feed mill, according to air quality permit data of the Iowa Department of Natural Resources. The company's website says it sells feed for cattle, dogs, goats, horses, pigs and poultry. Satellite images of the site depict several large grain bins.

The Iowa Department of Agriculture said Friday it suspended B & B Farm Store's grain and warehouse licenses pending an administrative hearing. The action came after Farmers State Bank, based in Waterloo, filed a petition in Buchanan County District Court seeking to foreclose on the Jesup business.

The bank said in the petition that B & B Farm Store, Donald L. Bloes and J&D Investors owe it $4.7 million for a series of loans that began in 2016, according to the petition.

District Judge John Sullivan appointed Habbo Fokkena, a Clarksville attorney, to act as receiver for the grain and livestock feed business. B & B Farm Store also has a retail operation.

A clerk at B & B Farm Store said Friday that none of the owners was available to comment.

Fokkena said Friday that Mid-Iowa Cooperative has agreed to provide feed for B & B customers, many of whom raise pigs. Grain and feed operations at the business ended last weekend, he said.

Fokkena said B & B owes as many as 40 farmers money, although more grain and livestock producers may be affected.

The state said in a news release that it was suspending B & B's licenses for failing "to pay for priced grain, grain shortage and recordkeeping violations." A spokesman for the agricultural department declined Friday to comment further on the suspended licenses.

Fokkena said Iowa's Grain Indemnity Fund would cover 90% of all losses for farmers selling to the licensed dealer. The state website says the fund covers losses up to $300,000.

The state's grain warehouse bureau oversees the financial solvency of grain dealers and grain warehouse operators, among other duties.

An "only in Iowa" moment went viral on Tik Tok when a Jesup man took his calf to Dairy Queen for ice cream.

Mason Corkery loaded the calf, Gucci, in the back seat of his pickup truck for the trip. He posted a video of himself and Gucci ordering a "pup cup" for the road on TikTok Saturday.

In the video, the 7-month-old calf gives Corkery licks while waiting in the drive-thru line before happily lapping it up on the ride home. As of Wednesday, the video had over 5 million views and 1 million likes.

Corkery and Gucci's adventures blew up on TikTok — where the pair has more than 170,000 followers. Other videos feature Gucci-related hijinks, from stealing pizza, eating peanut butter and bathtime in the barn.

Gucci lives on Corkery's family farm after the farmer met him while working at Hook Stock Farms in Grundy Center, according to the Waterloo-Cedar Falls Courier. The calf was born prematurely, so Corkery took special care of him and the pair developed a special bond.

Since the Dairy Queen video, the two have made appearances on ABC's Good Morning America, CBS News and other outlets to share their story. Corkery wants to use his and Gucci's sudden TikTok fame to promote local farmers.

“Some people do care about their animals, and it’s their livelihood. Not all farming is bad,” Corkery told the Courier.
