What we know:
Chad and Melissa Vannoy say they are paying to live in the home, but say they can't, and they're not alone.
"It was our safe place, it's what we put everything into. It was our dream home," said Chad.
In their lawsuit against Ashton Wooda Homes, the Vannoy's claim there were elevated amounts of toxic black mold in multiple areas of the second floor.
"As soon as we knew there was mold in the home, we vacated. We had to go," Melissa said.
"It's hard to live in a house you really know is hurting your family, and we've had a lot of health issues," said Scott Krebsbach. "We had to make a real tough decision, and basically live in our trailer for a couple of months looking for temporary housing."
The Krebsbachs are also suing Ashton Woods Homes, alleging negligence breech of contract and fraud.
"We had testing and our home was deemed to be uninhabitable," said Kyle Stephens. "But we were not able to move out and continue paying mortgage utilities for one house while renting another house."
The Stephens family say they only reside in about a fourth of their house downstairs.
"I want to move on. I want my kids to have sleepovers," said Maria Stephens. "I want them to be able to invite their friends over."

In March 2024, FOX 26 told you about Ashley Ollie's legal battle with Ashton Homes.
Her case is now settled.
Attorney Ernest Freeman says the families he represents in League City have all suffered greatly because Ashton Woods constructed homes, which foster mold growth.
He says his clients did not cause or contribute to these problems.
What they're saying:
Ashton Woods sent FOX 26 a statement, "Ashton Woods has tried to resolve this situation. We continue to work through the homeowners attorneys and remain hopeful that a resolution can be reached."
