MOODY – The Moody City Council approved an agreement that will allow an as yet unnamed company to establish a location at a long unused property during a regular meeting on Monday, Jan. 8.

Heads of departments gave their reports for the month of December. Police Chief Reece Smith reported 1, 184 calls, 32 traffic accidents, 132 citations, 150 reports, 55 misdemeanors, 16 felonies, and $4,421.19 was spent on vehicle maintenance.

For the fire department there were 172 responses, nine fires (three residential, one vehicle and five woods, grass or rubbish), 90 emergency medical calls, seven wrecks, 15 public assists, 22 lift assists, 28 false alarms, and four mutual aids given. There were 34 annual inspections, 13 re-inspections and one fire pump inspection.

The council opened a public hearing in which City Attorney James Hill outlined a reimbursement redevelopment agreement between Moody, St. Clair County and Trussville Retail for the redevelopment of a property located near highways I-20 and 4-11 and had once been occupied by a Krystal location.

The agreement would incentivize the development collectively with $450,000. The city would pay $360,000 and $90,000 by the county. This would be done through a return or rebate of taxes, Hill said.

Hill said that he was under a confidential agreement not to mention the company yet but that it is a “national, regional restaurant brand store.”

“This particular development will address potential city blight or county blight in that particular location,” he said.

Additionally, the council considered a Certificate of Indebtedness that would evidence indebtedness of the city applicable to the reimbursement agreement between the city, the county and Trussville Retail.

St. Clair Economic Development Director Don Smith was present and said that the county was expected to approve the agreement in the following morning and that the EDC recommended the project to go forward.

“This is a project that I’m very excited about,” Hill said. “This is one of those things that’s going to be great for the city of Moody and one that I hope that the public will be excited about.”

No one else spoke during the public hearing before the council unanimously approved both resolutions. Hill estimated that the project would begin in the next 90 days.

MOODY, Ala.—Richard Harp couldn’t believe his ears.

On Thursday, he heard for the first time from Inside Climate News that an EPA official had publicly confirmed what he already knew—the massive underground landfill fire near Moody, Alabama, just a football field away from his home, is still burning. In fact, the official told ICN, it may never be extinguished.

Harp was shocked by the admission. He and his family moved from their Moody home to a rental in Irondale, Alabama, after open flames consumed dozens of acres, leaving residents to deal with the impacts of the resulting smoke. But Harp, a minister and former firefighter, said that he’s been concerned about the EPA and some media outlets’ characterization of the fire, which he felt had suggested it had been extinguished.

On Thursday, following up on residents’ concerns about a continued underground fire at the site, Inside Climate News contacted EPA officials with a simple question: Is the landfill fire near Moody, Alabama, still burning either above or below ground?

In a resulting interview, James Pinkney, section chief of public and governmental affairs for EPA Region 4, confirmed that the underground fire in Alabama continues to burn.

“With a landfill, you can never really extinguish the fire. All we can do is respond,” Pinkney said. “And what we’re doing—the approach we took at this landfill is using soil to basically suffocate the flames. But a landfill can burn for an extended period of time underground.”

Harp said that Pinkney’s statement is the first time he’s heard an EPA official confirm that the fire continues to burn underground. He said that he has felt that state and federal regulators have done their best to underplay what’s continuing to unfold in Moody, just southeast of Birmingham. His fears were confirmed when he received a copy of a thermal image of the site that showed continued underground burning not visible to the naked eye.

The landfill blaze began at the Environmental Landfill northeast of Birmingham, near Moody, in November 2022. The landfill’s operators could not be reached for comment on Thursday. In the 15 months since it first flashed to the surface, the subterranean fire covered dozens of acres, with burning material reaching more than 150 feet deep.

The fire and resulting smoke left residents suffering from health impacts and schools limiting outside activity. All the while, state and local officials pointed fingers as to who should be responsible for dousing the flames. Only after federal officials stepped in was the fire smothered with sand.

But what came in the months following the initial EPA response has been anything but comforting, according to Harp and David Butler, staff attorney for Cahaba Riverkeeper, an environmental nonprofit that’s monitored the situation in Moody since its onset.

Butler said that the public perception of the situation has been that the fire was extinguished months ago.

“They haven’t updated their public-facing website since March of last year,” Butler said. “It is completely unacceptable. I believe their intention has been to just calm people down—to prevent them from pushing for more answers.”

Pinkney said that the EPA will continue to respond to any reports of hotspots as they’re made aware of them.

“We have a local contractor that we’ve hired if there are hotspots, or if we see smoke,” he said. “We address it at that time.”

Pinkney, a longtime Moody resident himself, said that the EPA will continue to have boots on the ground as long as necessary.

EPA’s strategy of covering the fire with soil means that as soil erosion occurs, the underground fire may be exposed to oxygen that can cause “flare ups,” Pinkney explained.

“So once we see that, we react to it immediately,” he said. “And that is why we will be here long term.”

Both Harp and Butler said that as long as there is a fire burning underground, they are concerned about the risks to public health. EPA officials should continue to collect and publish air samples from near the site, they argued.

Pinkney said that a full “suite” of air monitoring was completed sometime around June and that another sampling is underway.

“If those results come back showing any type of contaminants that are being released in an area, then, of course, we’ll have we’ll address the public,” Pinkney said. “We’ll make sure that the public understands what’s going on out there in that area to give them an opportunity to, you know, if there’s a need to evacuate or to move out of the area, they can make an informed decision. But as of right now, we haven’t received anything that would indicate that need.”

If the EPA believes no risks exist, Butler said, they should be transparent and regularly release their data to the public.

“Over the last month, they’ve been out there almost daily,” Butler said of the EPA. “And so why isn’t that reflected in that public facing website? All these people have questions about it, and they’re not giving any answers. I don’t understand it.”’

Even when covered by material like soil, underground fires can last for years because of small amounts of oxygen that provide a catalyst for any material still left in the site.

Robert Gray, a fire ecologist, told the CBC in 2019 that underground fire can become particularly persistent in dry conditions and in places where a lot of fuel is present.

“You need a combination of very deep ground fuel — that means duff and litter and roots and buried logs — and then you need drought conditions,” Gray said. “If you have that combination, then you have fires that can get into that deep, deep, dried organic material, and with just a little bit of oxygen they can hang on for years.”

While the landfill near Moody had been permitted to accept only vegetative material, concerns about other types of hazards burning underground have left residents worried about the air they’re breathing. Butler said it’s not reasonable for the EPA to conclude that there are little or no health impacts as long as there are no open flames or visible smoke at the site.

“That’s absurd,” he said. “You cannot look at air or water and understand what pollutants it’s carrying. Without ever investigating what is buried there, I don’t know how anybody could be comfortable that the fumes coming off that landfill are not dangerous.”

Butler said as long as the fire continues to burn, even underground, residents should push for answers about the impacts on the environment and on their own health.

“We believe that as long as that fire is burning that there’s a risk to everybody that is around it,” he said. “The only way to mitigate that risk is to understand what’s actually burned, and regulators have done nothing to do that.”

Pinkney is not ignorant of the impacts of the landfill fire. The EPA official said that early on, he couldn’t be at the Moody site for more than a few minutes.

“It got to the point where it was really affecting me,” he said. “So you can only imagine the people around there, how it affected them.”

Harp said he wants the fire near his home extinguished completely, not just smothered with soil. He doesn’t buy the argument that the EPA, the world’s largest environmental regulator, doesn’t have the ability to put the blaze out.

Pinkney said that other options like firefighting foam present risks because of the so-called “forever chemicals” they contain. Water, he said, isn’t a good option because of the runoff pollution it would cause.

Harp said he doesn’t buy that no other option exists, suggesting that, for example, a layer of polypropylene could be placed over the site to help prevent oxygen from reaching the smoldering embers.

“That’s a load of manure,” he said of Pinkney’s claims. “You can put a fire out. Dirt is organic, and it is porous. And it will never extinguish a fire, especially at a thickness of 150 feet. I’ve talked to a landfill engineer about it, and you can’t tell me that the head of EPA can’t talk to a landfill engineer. If they don’t know how to put it out, they need to find someone who does.”

The Blue Devils dealt the Panthers (7-2, 5-1) their only loss in region play. Junior quarterback Charlie Johnston finished 12-for-15 passing for 177 yards and a pair of touchdowns, while Burke added 71 yards on the ground and converted a 2-point conversion after Johnston scampered 20 yards for a score to put Moody up 21-0 in the second quarter.

Johnston hit Kadarius Barnes for a 6-yard TD to open the scoring on Moody’s first drive, and Chase Jackson picked off the Panthers’ Jordan Bryan and scooted 22 yards for a touchdown and a 14-0 lead.

Southside-Gadsden running back Mason Teague was limited to 62 yards and a touchdown due to four holding penalties in the first half that brought back huge gains. Bryan finished the night 7-for-15 passing for 114 yards and an interception. He also ran for two scores.

“I’m proud of them,” Moody coach Jake Ganus. “I didn’t come here with winning a region championship on my mind, but it’s part of being a good football team to win the games you’re supposed to win. Ultimately the goal is to try to get in the dance and then go win five one-game seasons, and we put ourselves in position to do that.”

This share of the Region 6 title is Moody’s first region title in 19 years.

“I was just thinking that it was a chance for us to get up,” Burke said of his scoring run. “It was a chance for us to give our defense a rest because it felt like they had been on the field for 10 minutes in the third quarter. I’m glad we got to give them a break and go up two touchdowns.”

For Southside, penalties proved problematic.

“Penalties was the difference in the game,” Panthers coach Miles Holcomb said. “In the first half, we couldn’t get out of our own way, shot ourselves in the foot. I thought our kids played hard, battled back in the second half … drove down, pretty much ate up the whole third quarter and made it a one-score game. It just came down to we didn’t make enough plays.”

Playoff push: Three teams are now tied atop the Region 6 standings – Moody, Southside and Leeds. Playoff seeding will be determined by the AHSAA tie-breaking procedures after the regular season is completed next week.

Top play: Jackson’s leaping interception and return for a score on Southside Gadsden’s first possession set the tone for the Blue Devils and let the Panthers know that Moody wasn’t going to be a pushover.

Key stat: Southside-Gadsden had a total of 94 rushing yards called back for holding penalties in the first half.

Moody landfill on fire again, EPA battling smoldering sinkhole north of Birmingham

The U.S. Environmental Protection Agency is back on the scene of the Moody landfill fire near Birmingham, where the underground smoldering blaze sparked anew after a sinkhole opened.

EPA spokesman James Pinkney said the agency was informed about the blaze yesterday and responded with an on-scene coordinator to assess the situation in Alabama.

Pinkney said there is a sinkhole approximately 15-20 feet in diameter at the site where smoke is coming from.

“With landfill fires, they’ll continue to burn underground and can flare up if they get air,” Pinkney said.

Pinkney said that the plan is to cover the smoldering area with dirt, and then check the rest of the site for hotspots and potential problem areas.

He said the EPA is waiting on equipment and fill dirt to arrive on site, but they hope to have the sinkhole covered by the end of the week.

“As soon as it gets here, the work will begin,” he said.

The fire started in November 2022, burning mostly underground and confounding local and state officials for months until the EPA agreed to take over operations at the site in January.

The agency used heavy equipment to grade and compact the disposal area, then cover it with truckloads of dirt and a landfill-style cap and planted the area with grass to prevent erosion. The EPA finished its main operations at the site around the end of April.

Because the landfill was considered a green waste or vegetative landfill, the operators were not required to follow the safety protocols of most landfills. The site before the fire was described as a massive stack of dead and decaying trees and vegetative matter more than 100 feet tall in places and loosely covered in dirt.

There was at least some unauthorized waste at the landfill as well, as inspections conducted before the fire found household trash, tires, electronics, and treated lumber in the disposal area.

The owners and operators of the former Environmental Landfill, Inc. have been fined $250,000 by the Alabama Department of Environmental Management and could face financial responsibility for the costs of EPA’s response to the fire.

Moody Fire Inspector James Mulkey said the department began receiving calls about wafts of smoke from the area around October 3.

“We’d been receiving calls about various smoke smells, and on the third we found some cracks on the backside of the landfill in the clay cap that had some smoke coming out of it,” Mulkey said.

Then on Tuesday, they discovered the smoldering sinkhole, which is when they notified St. Clair County and state officials, who contacted the EPA.

High school football made its glorious return all over the state on Friday night. It felt like the hottest day of the year. Even the mosquitos were sizzling. Naturally, things got a little testy in a city called Moody, but was anyone expecting a different outcome with Propst once again walking the sidelines in Alabama?

Propst is at Pell City. His goal is to build the school’s underachieving football team into a powerhouse and then retire. He put together a heavyweight staff of assistants to do it and the team looks better than anyone was expecting. It’s a wild story and it officially all started on Friday night in St. Clair County. Count Moody coach Jake Ganus among the people who didn’t expect to see Propst — renowned for offensive innovations — break out the triple option for his big return to Alabama high school football.

Propst had everyone fooled for his first game in his home state since resigning from Hoover in 2007, and his opening gambit was almost enough against one of the state’s most talented up-and-coming coaches. Moody was a heavy favorite in this one. It took a while, but the better team found its form in the second half.

Ganus’ so-called “411 Boys” shined when it mattered most.

Behind a raucous home crowd, Moody roared back from a first-half deficit and won its highly anticipated season opener 28-24. Pell City had a chance to win it in the end, but Moody’s defense sacked visiting quarterback Nikita Getmanshchuk to put the game away.

“I’m proud of our guys,” said Ganus, who played college ball at UAB and Georgia. “I can’t say enough about their fight. Hats off to Pell City. By far the most improved team I’ve seen in a year’s turnaround.”

That’s the Propst Effect, and it only seems like a matter of time before Pell City begins sending some shockwaves through the state. Lightning almost struck in Moody, but Propst left upset about an offensive pass interference call in the second half that canceled out a Pell City score.

“That was probably the worst call I’ve seen in high school football in my life,” Propst said on Pell City’s local radio postgame show. “In 41 years, I’ve never seen an offensive pass interference that bad. I tried to go back in all my career, and I think that’s by far the worst call that I’ve ever witnessed in a football game on pass interference. I mean, I don’t even know what he’s looking at. … I went and looked at it on the iPad and ran it back about 18 times. There’s no way that was pass interference.”

It was one of the game’s pivotal plays, but there were others.

Blown coverage by Pell City’s defense on third and 21 kept Moody alive in the second quarter. On the play, a 62-yard touchdown throw from Moody quarterback Charlie Johnston to receiver Braden Wright cut Pell City’s lead to 10-7. It was Moody’s only significant offensive gain of the entire first half. Moody ran just three offensive plays in the first quarter with Pell City’s triple-option FrakenRush offense eating clock and energy in the relentless Alabama heat.

The rivalry was not without sufficient displays of sideshow shenanigans. The two teams had to be separated before the game and then again near the end of the first half after a Moody player was flagged for a late hit on Pell City’s Caleb Groce.

During the dust up, Propst threw his headset at his son, player John David Propst, to prevent the sophomore receiver from running into the commotion. The headset broke when it made contact with John David Propst’s helmet, but a handy sideline technician repaired the communication device in seconds.

Propst momentarily lost his cool during the game, but afterwards said his return to Alabama high school football was less emotional than he expected it to be.

“You just coach football,” Propst said. “It’s a game of football and it’s about the kids and trying to win a game in a tough situation.”
