FABENS, Texas (KFOX14/CBS4) — A sickly 6-year-old pug that was rescued from a Fabens home is back in intensive care.
As it was reported on Tuesday, a pug named Toby was rescued from a home on the 1000 block of NW 2nd Street in Fabens after there had been reports of a severely underweight dog.
Toby was found on June 17, and his owner, 26-year-old Kimberly America Frescas, was arrested on June 22 and charged with cruelty to non-livestock animals.
However, on Thursday, a spokesperson from the El Paso County Sheriff's Office said Toby unfortunately experienced a "medical setback" and had to go back into intensive care.
It is unclear what type of "medical setback" Toby suffered, but given his condition and ongoing treatment, the Sheriff's Office said he is not available for adoption yet.
Toby remains under the care of PAWsitive Rescuers of El Paso.

According to the arrest report, Toby had been sick for over two weeks when he was rescued.
It is unclear what ailed him; however, Frescas, the owner, allegedly told authorities that Toby had gotten sick after eating pizza, causing him to vomit and defecate a black tar-like substance and not eat or drink water.
Investigators believe that Toby's refusal to eat or drink water is a lie, as the vet who later cared for him said the dog ate "ravenously" when they fed him canned dog food at the clinic.
Investigators also said that when they asked Frescas why she hadn't taken Toby to the vet after Toby had been sick for two weeks, she allegedly said she couldn't afford it.
The Sheriff's Office reported that Frescas allegedly told them that she wished for Toby to "just pass away already."
According to jail records, Frescas was booked into the El Paso County downtown jail on Monday under a $4,000 and was released on Wednesday after posting bail.
