By providing your phone number and opting in to receive communications from Always Best Care or its franchisees, you agree to the following SMS Terms & Conditions: 

  • Communications & Message Types: By opting in, you consent to receive text messages (SMS/MMS) from Always Best Care and its local franchise locations. Messages are strictly transactional, operational, and customer care-focused, including: 
  • Appointment reminders and assessment confirmations 
  • Service and caregiver schedule updates 
  • Customer support and care consultation communications (Note: Text messaging is used strictly for customer care operations; no promotional, marketing, or mass broadcast text messages will be sent). 
  • Message Frequency: Message frequency varies depending on your interactions with our services, care schedule updates, or ongoing care inquiries. 
  • Message & Data Rates: Message and data rates may apply depending on your mobile carrier plan. Always Best Care is not responsible for any charges incurred from your mobile provider. 
  • Opt-Out Instructions: You can opt out of receiving text messages at any time by replying STOP to any message. After sending STOP, you will receive a single confirmation message verifying that you have been unsubscribed. You will no longer receive SMS messages from us unless you opt back in. 
  • Help & Support: If you need assistance, reply HELP to any text message, or contact support directly at: 
  • Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages. 
  • Privacy Policy: Your mobile information will be handled strictly in accordance with our Privacy Policy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. 

Intellectual Property 

You are granted a non-exclusive, non-transferable, revocable license to access and use the Sites strictly in accordance with these Terms. As a condition of your use of the Sites, you warrant that you will not use the Sites for any purpose that is unlawful or prohibited by these Terms. Digital Millennium Copyright Act (DMCA) Policy 

Our policy is to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (“DMCA”). If you believe that any content on the Sites infringes your legal copyright, please send notice to: [email protected].

Electronic Communications 

Visiting the Sites, utilizing online forms, or sending emails to us constitutes electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. ALWAYS BEST CARE HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SITES AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.  

IN NO EVENT SHALL ALWAYS BEST CARE, ITS FRANCHISEES, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITES. 

BY USING OUR SITE, YOU ACCEPT THESE TERMS AND AGREE TO VOLUNTARILY WAIVE ANY RIGHT TO TRIAL BY JURY AGAINST ALWAYS BEST CARE FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR OUR PRIVACY POLICY. ALL CLAIMS MUST BE LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS ACTION OR CONSOLIDATED BASIS. 

Governing Law, Venue, and Jurisdiction 

These Terms shall be governed by and construed in accordance with the laws of the State of California and the laws of the United States, without regard to conflict of law principles. Any claim or dispute related to the Sites, these Terms, or the Privacy Policy must be instituted within one (1) year after the claim arose or be forever barred. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Placer County, State of California. 

Miscellaneous 

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Always Best Care regarding your use of the Sites. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
