Always Best Care Senior Services consists of ABCSP, plus our parent company ABCSS Holdings, LLC, a Delaware Limited Liability Company, and serves as franchisor to the independently owned and operated Always Best Care Senior Services franchisee businesses (“Network”), including Cothran Innovations LLC, doing business as Always Best Care Wake Forest (https://alwaysbestcare.com/wake-forest/).

Scope of this Privacy Policy 

This Privacy Policy covers Personal Information collected through the Always Best Care Senior Services digital properties to which this Privacy Policy is linked. It also covers information we obtain from you through our applications, software systems, social media pages, or otherwise as described in this Privacy Policy. For purposes of this Privacy Policy, we refer to these digital properties and access points as the Always Best Care “Platforms.” 

Any client health data that is “protected health information” subject to the Health Insurance Portability and Accountability Act (HIPAA) and its implementing regulations, or similar laws of the local jurisdiction, must be requested directly from the appropriate franchise office. 

“Personal Information” means data about an individual who can be identified from that data, or by combining it with other data. Personal Information is usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another. 

Mobile Messaging & Text Privacy (TCR & Carrier Compliance) 

We are committed to protecting consumer privacy regarding mobile text messaging communications: 

  • No Mobile Information Sharing: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties or affiliates. 
  • Types of Messages Sent: Mobile numbers collected for text messaging (SMS) are used strictly for transactional, operational, and customer care communications, including care assessment confirmations, appointment reminders, caregiver scheduling updates, and direct customer support.

Why Do We Gather Information? 

We gather information from you to communicate with you and inform you of the broad range of senior services we offer. We also use the information automatically collected about you during your use of the Site to improve the effectiveness of our Sites, operations, mobile experience, or marketing efforts, to prevent fraud and theft, and otherwise to protect visitors to our Site and business. 

What Information Is Collected?

We collect Personal Information as described below. Franchisees may also collect this information, to which Always Best Care may have access solely for the purpose of maintaining its franchise systems, marketing, brand standards, and other franchisor activities. We also receive Personal Information from third-party lead generators to whom you have given consent to share your interest and that information with us. 

Always Best Care collects information you provide us through your communications between you and the Platforms, such as an inquiry about our services or opportunities to franchise with Always Best Care. Information collected includes information voluntarily provided by you and may include information such as your name, email address, phone number, and physical address, and the patient’s name, if different from your own. The Platforms may also collect general information about your technology preferences (such as the type of browser used or the files requested). 

Personal Information Categories 

Personal information may include: 

  • Contact information, such as name, phone number, email address, or physical address; 
  • Information regarding interest in non-medical in-home care, assisted living referral services, or skilled home health care; 
  • General financial information such as credit score, approximate net worth, or capital available to invest in a business; 
  • IP address and browser information to measure website traffic and personalize your experience; 
  • “Cookies” and tracking technologies that allow us to recognize you during navigation. 

How Is Personal Information Used? 

We use your Personal Information to provide you with information you have requested, to contact you in response to your inquiries, and for a variety of operational purposes including: 

  • Coordinating personalized care assessments and managing care schedules; 
  • Responding to direct customer service inquiries and support requests; 
  • Providing information regarding Always Best Care and future offers or services via email or phone; 
  • Developing additional services and evaluating platform performance. 

Note: Mobile numbers provided for text messaging will never be used for mass marketing or promotional broadcasts. 

We do not collect or maintain “protected health information” through our Sites. Protected health information is governed by HIPAA and subject to the local franchisee’s Notice of Privacy Practices. 

Information Use and Sharing 

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. 

Except with your consent, we share your Personal Information with third parties only in the ways described in this Privacy Policy: 

  • Service Providers: We share personal data with trusted service providers and sub-processors strictly to assist in operating our website, managing care schedules, processing payments, or delivering customer service. These companies are prohibited from selling your data and authorized to use it only as necessary to provide contractually obligated services. 
  • Franchise Network: We may share information with independently owned and operated franchisees and affiliates for client engagement, lead management, and service coordination. 
  • Legal Obligations: We may release Personal Information to law enforcement or regulators when reasonably necessary to comply with legal requests, court orders, or to protect the rights and safety of our clients and business. 

Guidelines for Children 

Our Sites and Platforms are not designed for children. We do not knowingly collect information from any person under the age of 16 and we do not market our products or services to children.

When you visit our Site, certain non-personal information is collected, such as IP address, device ID, browser setting, operating system, and cookies. We use cookies, pixels, and tracking technologies to enhance site functionality, analyze usage patterns, and optimize user experience.

  • Sharing: Consumer Health Data is shared only with trusted processors and service providers necessary to deliver requested care services, or as required by law.
