Property Owner Clashes With Tenants Over Rent Control

LOMITA, Calif. — When Paul Rajewski's company bought an eight-unit housing development in Lomita last year, he said he knew it meant taking on a collection of fixer-uppers.

But Rajewski shared that he was shocked to discover some of the unsanitary living conditions the tenants he inherited had settled into.

“When the person left, this was full of old, beat-up furniture that we had to remove," Rajewski said giving a tour of one of the now-empty units. “I mean look at this, it’s mouse crap. This isn’t something we condone."

The unit on 250th Street that Rajewski showed Spectrum News 1 was vacated weeks ago, but still smells like animal feces and urine.

Rajewski says his team at Pinnacle Investments had to dump 10 tons of flea-infested furniture and belongings when the previous tenant was evicted for not paying rent.

“This place was so bad and infested with fleas and bugs, the carpet was terrible, you can see where the cat used to enjoy himself on the floor," Rajewski said.

His company's plan is to completely renovate the two-bedroom cottage and the seven others around it. Rajewski said their crews are mitigating a termite problem, replacing roofs and fixing cracked foundations in the poorly-maintained units.

With significant renovation comes a rent increase, one that Rajewski believes will bring the housing development closer to fair market rent and to livable conditions.

But before any units were fixed up, rent already went up.

For tenant Bill Johnson, it rose from $1,500 to $2,000 per month, which is more than the new state rent control law allows as of this year.

“I’m on social security disability, the only income I have is that. I have no credit, I can’t even rent a dog house,” Johnson said. “I’m on social security disability, the only income I have is that. I have no credit, I can’t even rent a dog house,” Johnson said.

Johnson moved into his unit in 2014 and until Pinnacle Investments bought the property his rent had never increased.

He's had to take on part-time work despite his disability to make ends meet.

“I try to work as many days, as many hours as I can. Bottom line, they don’t care if we live or die,” said Johnson.

With a lack of affordable housing the issue of rent control versus capitalism and incentives for developers to invest is playing out across the City of Los Angeles.

The issue in Lomita came to a boiling point over the Christmas holiday.

Pinnacle issued 60-day notices in October asking tenants to move out so renovations could begin. The residents took the issue up with city officials.

Lomita's city council stepped in with an urgency ordinance that overturned evictions until the new statewide rent control law went into effect on January 1.

The Mayor of Lomita, James Gazeley, told Spectrum News 1 he was uncomfortable issuing the ordinance because he wasn't able to hear from both sides and city officials hadn't visited the property.

Under the new California rent control law, Pinnacle had to roll back rents to the rates tenants had in March 2019, plus five percent and the rate of inflation.

“Investors aren’t going to build something if they’re not going to make money. Investors don’t look at the world that way," Rajewski said. "And I don’t think we should let our tenants live in bad conditions, I don’t think that’s a good way to operate our business.”

Johnson told us he doesn’t want to leave his unit and he also doesn’t want it renovated. He just wants to pay his previous rent.

But Pinnacle has raised concerns about the living conditions inside. Johnson declined to let Spectrum News 1 see them.

Johnson insists he shouldn’t be forced to move.

“They want to throw us all out and take their time fixing it up and charge $2400," Johnson said.

According to Pinnacle, Johnson and his neighbors have been offered multiple options for relocation, including units in other areas Pinnacle manages that are more affordable.

Rajewski said his company gets turned down.

“Bill could save $300 if he moved to Long Beach. Bill could save a lot of money if he got a roommate," Rajewski said. "I don’t think it’s right to hold a property owner hostage for the way someone else wants to live.”

Pinnacle plans to move forward with renovation plans, which means new 60-day notices for the tenants.

Rajewski said he’s willing to work with them on solutions, but won't halt the work his company is putting into his investment.

I want to explore in greater detail what I mentioned in a post awhile back regarding the government’s use of Torrance Municipal Airport, then known as the Lomita Flight Strip, to house Japanese Americans returning from internment camps following World War II.

During the war, the government owned the Lomita Flight Strip, and had been using it for training Army Air Corps pilots. Barracks for trainees had been built on its western end.

The Army left at war’s end and the government gave the site to the city of Torrance, but retained control of the airstrip temporarily.

The return of the more than 110,000 relocated Japanese Americans from internment camps posed a variety of logistical problems for the U.S. government. Houses, land and possessions had been taken from many of them, and some of them were ill.

The agency in charge, the War Relocation Authority, had to find temporary quarters for the internees, more than half of whom were U.S. citizens, while they were attempting to re-assimilate back into society.

The WRA decided, in September 1945, to house about 125 Japanese American internees from about 78 families in the barracks at the flight strip. They were returning from Camp Granada in Colorado, the first internment camp to close. All the camps had been ordered closed by Oct. 15 because of government budget cuts.

The Lomita Flight Strip encampment was the first of 16 regional relocation centers in the greater Los Angeles area to be used for resettlement staging.

Leslie Lahr, commander of the Lomita post of the Veterans of Foreign Wars, protested immediately. The VFW felt that all available temporary housing, including the flight strip, should be used for returning U.S. servicemen instead.

Regardless of the objection, the first families moved into the barracks on Oct. 8, 1945. Only families in good health were accepted; those who were ill, aged or indigent were referred to local welfare agencies.

Life in the barracks wasn’t all that different in some ways than life in the camps had been. The grounds were secured at all times by armed guards, for example. But this time, they really were there to protect the former internees from unauthorized visitors.

A San Pedro News Pilot article from Oct. 8, 1945, described the accommodations as follows:

“The flight strip barracks, set aside by the WRA, are essentially unchanged from army quarters. Carpenters have divided the empty barracks into partitioned cubicles. These have been furnished with army cots and mattresses. Cooking will be done army style, with the families eating in mess halls. Washing will be done in a community wash room equipped with hot water boilers and wash trays. It is expected that barracks will be heated with oil stoves.”

For this, the internees had to pay monthly rent, as well as pay for meals.

Over the next few months, families arrived from former internment camps all over the West, including the Colorado River camp near Poston, Arizona; the Tule Lake camp in California, near the Oregon border; and the Hart Mountain camp in Wyoming.

Additional trailers were brought in to handle the overflow at the temporary camp, which grew to more than 1,000 residents by early 1946. About one-third of the residents were children, who were placed in area schools.

Most went to Walteria Elementary at first before being moved to different schools to reduce crowding. Walteria had to hold classes in the auditorium and eventually build two additional classrooms to handle the initial rush of students.

The WRA brought an employment counselor on site to help the able-bodied find work. Some returned to agricultural jobs on South Bay and Palos Verdes Peninsula farms, while others found work as domestics or in local industries.

The numbers of those remaining at the camp began to dwindle during the spring of 1946. The WRA announced it would close the facility by July 1. Many families eventually were moved to the Winona Housing Project trailer camp, at Hollywood Way and Winona Avenue, in Burbank.

The last families left the flight strip barracks on June 28, with some going to on-site training centers at Cal-Sea Food Co. in Harbor City and the rest to flower grower Fred H. King’s farm in Torrance.

With the barracks now empty, James Caldwell, head of the Torrance Area Veterans Service Center, began his fight to allow returning war vets to use the barracks as temporary housing.

After initial resistance from the Torrance City Council, he succeeded. Veterans began moving into the barracks in August 1947, using them as temporary housing until they could find jobs and places to live.

After that, Torrance’s National Guard units occupied the barracks and additional ones trucked in from Fort MacArthur, while they were based at the airport temporarily from 1948 to 1950, before the permanent National Guard armory in Torrance was built.

The often-used buildings finally were removed in favor of new hangars after the city of Torrance took control of airport management on April 1, 1958.

Lomita has stopped using a 5 million-gallon emergency reservoir that blends local groundwater and more expensive imported water, another fallout from the discovery of cancer-causing chemicals in the water supply, prompting renewed criticism from some residents that the $13 million project doesn’t work as designed.

An annual state test at the end of May found the chemical benzene, a known carcinogen, in groundwater at levels almost three times higher than is allowed in California, prompting Lomita to shut down its well and water treatment facility.

That, in turn, required the reservoir atop hilly Cypress Avenue — which serves about two-thirds of the city’s 4,242 water users, in the area generally north of Pacific Coast Highway — to be drained. The emptying of the reservoir, intended to provide an emergency supply during a natural disaster, has resurrected grumblings about the cost and effectiveness of what remains the most expensive capital expenditure in city history.

That’s because the project has been plagued with problems. Water delivered to households from the Cypress Avenue Water Treatment Facility, for example, has a long history of taste and odor issues. That’s one reason the city has a dedicated website — LomitaWater.com — devoted to offering solutions to residents with questions and concerns about what comes out of their taps.

And the city is still paying about $400,000 annually to retire the outstanding $6.5 million debt that remains on the 10-year-old facility it isn’t currently using, municipal officials acknowledged.

“The residents were sold the reservoir on the mistaken belief that in a major emergency, we would have a multi-day supply of water already in our city for firefighting and drinking,” resident and real estate agent George Kivett wrote on local social media site NextDoor.com. “Basically, the tank doesn’t work as planned.”

On Wednesday, Sept. 4, Kivett reiterated his displeasure at the city’s ongoing water problems.

“It’s a disappointment,” he said in a telephone interview. “That’s never really lived up to expectations and now it’s empty.”

The water well and treatment facility were also intended to reduce the city’s reliance on more expensive imported water. But the city, since shutting down the well, has upped its use of imported water.

Municipal officials, for their part, maintain the reservoir is empty only temporarily and will be refilled when normal operations resume.

But it’s unclear when that will occur.

State officials are currently probing the source of the contamination and will eventually decide whether a proposed $3 million filtration system at the Cypress Avenue Water Production Facility will reduce the benzene levels.

The Los Angeles Regional Water Quality Control Board has identified three potential sources of the carcinogen near the water treatment facility, but has yet to confirm whether any are responsible for the chemical ending up in Lomita’s groundwater.

The filtration system, already in the works before the benzene contamination was discovered, was initially designed to solve the persistent aesthetic complaints from residents over water quality that have dogged the production facility since it came online.

“We’ve had questions from our residents for some time about taste and odor (issues) primarily,” City Manager Ryan Smoot said. “Turns out, the project we’re already designing is the best practice, the recommended treatment for benzene as well.”

And that, at least financially, might actually help the city.

“The good news for us is because we’re now treating a primary health and safety concern, we may qualify for grant funding for this,” Smoot said. “So if we can kill two birds with one stone and not have it cost us a dollar, that’s a win for us.”

The issue with benzene in Lomita’s drinking water is separate from the contaminated groundwater discovered beneath some homes in the community, which has emanated from an industrial site in neighboring Torrance, near Zamperini Field.

A second investigation, by the Los Angeles Regional Water Quality Control Board, is also under way to analyze the extent of that contamination. Experts have said they do not believe the two, essentially at opposite ends of the 2-square-mile city, are related.

Leaking underground oil storage tanks at three locations near the water production facility could be sources of the contamination, state officials said.

Those include underground tanks at the Lomita Sheriff’s Station on Narbonne Avenue, about 450 feet from the well. A work plan was to be submitted Aug. 30.

The other two sites are a Shell gas station, also on Narbonne Avenue, that was formerly operated by ExxonMobil, and a CVS Pharmacy on the former site of a car wash.

All the investigations are in their very early stages and are yet to begin, state officials said.

Groundwater contamination from abandoned or leaking underground gas tanks is relatively common because clean-up costs can reach as high as $1.5 million, federal EPA officials said.

About 400 tanks in California have been cleaned-up since 2013.

Aesthetic water quality issues, meanwhile, became apparent as soon as Lomita opened the Cypress Avenue facility almost 10 years ago.

It was shut down just two months after it opened when residents complained about the taste and odor of water, Mayor Henry Sanchez recalled.

Initially, 100% well water was used. But the city began blending the well water with imported water to make it more palatable.

In 2013, the state warned the city that a proposed water blend had a level of contaminants above the recommended range “for consumer acceptance.”

A “terrible design” of the storage tank exacerbated water quality problems as well, Sanchez said, which also had residents complaining about damaged appliances and pinhole leaks in household pipes.

Lomita and the company that designed the tank eventually reached a settlement that allowed the city to modify the tank to ensure improved water circulation, and reduce the odor and taste problems.

Yet now, after finally believing they were on the verge of a solution to the longtime water quality issues, the city has now found itself waiting on whether state officials will approve the filtration system for the benzene contamination, too

But Smoot, in a recent interview, rejected the contention that the water production facility has turned out to be an expensive dud, instead calling it “prudent” investment by the City Council.

“It’s more than a storage tank, it’s more than a treatment facility,” he said. “The Cypress Water Production Facility is what will allow this city to be independent of imported water in the future.”
