What Steps Should Be Taken After a Pedestrian Crash in Paxton, MA?
After a pedestrian is hurt by a vehicle, one of the first priorities is getting appropriate medical attention, since head injuries in particular can involve complications that aren't immediately obvious. Prompt evaluation by medical professionals helps make sure nothing gets missed in the initial response.
Once medical needs are addressed, it becomes important to document the scene, though this usually falls to responding officers and witnesses rather than the injured pedestrian.
Massachusetts law allows an injured pedestrian to pursue compensation from a negligent driver, and details like the vehicle's speed, lighting conditions, and roadway markings can all factor into how fault gets evaluated.
This state also follows a modified comparative negligence rule, which means a pedestrian can still recover compensation as long as they are not found more than 50 percent responsible for a crash.
Medical records that document the injury and its treatment become a central piece of evidence, especially for injuries involving the head, where long-term effects can be harder to predict early on. A pedestrian accident lawyer can help gather this documentation and make sure a claim reflects the full extent of the injury as treatment continues.
