LA GRANGE, IL – A top Lyons Township High School official said this week she wanted to clarify the school's position on selling its land in Willow Springs, which sparked an outcry earlier this year.

At a school board meeting, Dawn Aubert, the board's president, spoke about last week's meeting at Willow Springs Village Hall.

A village consultant said Willow Springs' zoning for the high school's 70 acres was proper and consistent over the last three decades.

The property is zoned for residential and light commercial uses, not industrial. The school board, however, tried to sell to an industrial developer earlier this year, keeping the village and a nearby elementary school in the dark for months.

At last week's meeting, residents and the village's attorney raised the possibility of the high school and a developer suing the village over the zoning. Residents also worried the school had not abandoned its effort to sell to an industrial developer.

Aubert acknowledged those concerns in a prepared statement at the school board meeting

"I would like to clarify that the board is not actively engaged in the sale of the property and that there are no potential buyers for the property and there is no pending litigation with respect to the district-owned property," Aubert said.

At the same time, she said, the board remains committed to using the land as an asset toward achieving its goal of upgrading the school's two campuses, referring to the money generated from a sale.

"Any future board of education discussions will be publicly posted per our normal procedures," she said.

Those normal procedures apparently weren't followed in January when the board held two closed meetings about the Willow Springs land. No notice was given.

Later, the attorney general's office found the board broke the law by discussing a land deal behind closed doors. The agency ordered the board to release the recordings, which the board did.

Those recordings gave some basis to the suspicion that the high school or a developer may sue the village.

In the closed sessions, the board's lawyer, Ares Dalianis of the Franczek law firm, suggested a lawsuit may be filed.

In his comments, Dalianis referred to the highest bidder, Bridge Industrial, which the school had privately courted for the better part of a year. He then imagined what he would be thinking if he were a Willow Springs official.

"I'm a trustee for Willow Springs," Dalianis said. "I'm like holy cow, these guys have nailed every one of the standards. They met the requirements to change (the zoning). They have the right expert here. I really don't have a choice but to vote yes or if I vote no, it's going to be the subject of litigation, and Bridge is going to file a lawsuit saying they didn't get fair treatment through the process."

A few months after the attorney general's order, the board replaced Dalianis' law firm.

Willow Springs officials have vowed they would stick to their zoning.

LA GRANGE, IL – Lyons Township High School has received the appraisal report for its 70-acre vacant property in Willow Springs.

But the school on Monday decided against releasing the document to the public.

Last year, the school worked toward selling the land to an industrial buyer. But it ended that effort after the village of Willow Springs and other public bodies objected.

Patch requested the appraisal last week.

In its response, the school said the appraisal report was "currently" exempt from disclosure under the state Freedom of Information Act.

Asked when the report would be disclosed, the school's spokeswoman, Mary Lin Muscolino, said in a phone interview, "It was not shared with me at this time when the appraisal would be publicly available."

Justifying its denial, the school cited two exemptions under the Freedom of Information Act, which requires the release of most public records.

One exception was for preliminary drafts and notes that are used before a public body makes a decision.

The other one applies to records and information relating to real estate purchase negotiations until the talks have been completed. School officials have not indicated they are in any type of negotiations for the land.

In getting the appraisal under current zoning, school board members said it was a key piece of missing information.

Two years ago, the board quietly got an appraisal for industrial uses. An appraisal put the land's value at $68 million. Under current zoning, the land is expected to be worth much less.

Through much of 2022, school officials privately courted developer Bridge Industrial. Closed session recordings showed the school board purposely kept other public bodies such as the village of Willow Springs and Pleasantdale School District 107 out of the loop.

Once the details went public, Willow Springs residents opposed the idea of an industrial development next to houses and Pleasantdale Elementary School. Other towns also joined in opposition.

Just weeks before last April's election, the board abandoned its effort to sell to an industrial developer. It later ousted its attorney involved in the process.

Such a public discussion is a far cry from the board's practice earlier this year.

In January, the board spent the better part of two hours of closed meetings debating what to keep secret from Willow Springs and other public bodies about the effort to sell the school's land in Willow Sprngs.

The attorney general later found the closed sessions violated state law, compelling the board to release the recordings.

In early August, board members agreed to a new approach to selling the school's 70 acres in Willow Springs. Last year, the school secretly courted an industrial developer that was interested in buying the land, which is next to houses, a school, a park and a UPS facility.

After the effort became known, Willow Springs officials and residents rose up in opposition. At one point, the village president called for Superintendent Brian Waterman's ouster.

Now, the village is studying the zoning for the land. It recently hired a consultant for that effort.

At Monday's board meeting, Superintendent Waterman said he wanted to delay hiring the board's own consultant. He said it was important to first see the village consultant's report, which is expected in a month.

Board President Dawn Aubert suggested Waterman email the village about the delay.

But other board members objected to sending such a message.

"I don't know why it's necessary," said member Michael Thomas, who previously pushed in a closed meeting a conspiracy theory about the land sale's opposition.

Member Jill Beda Daniels agreed with Thomas.

"They can follow our meetings and attend if they had chosen," she said, adding she feared that such an email would set a precedent.

Aubert, however, said it would be a "transparent courtesy" to contact the village, noting the board agreed to take a new approach. She said village officials had attended previous board meetings, but the board's agenda for Monday included nothing about the land.

Members Kari Dillon and Elvia Nava also expressed concerns about sending an email.

Waterman, though, said it would take a couple of seconds to email his statement on the issue.

"I think we're probably overthinking this a little bit," he said.

Aubert and member Jill Grech also said the board was overthinking it.

Member Tim Albores initially wondered whether the board was overreaching its authority by involving itself in whether the superintendent should send the email.

By the end of the discussion, though, he said the board was offering an "olive branch" by delaying the hiring of a consultant. As such, he said he didn't think it was necessary to reach out.

Aubert concluded that no email would be sent.

"We'll leave it at the meeting and go from there," she said.

LA GRANGE, IL – The Lyons Township High School board is losing enthusiasm for hiring a consultant to gauge what the public wants to do with the school's Willow Springs land.

At a meeting this week, two members said they were ready to vote to sell the 70 acres of wooded land.

This followed a report from Superintendent Brian Waterman on the effort to find a "community relations research specialist."

Waterman said the school contacted a half dozen firms about the opportunity. But only one responded, with costs ranging from $21,000 to $23,000, depending on what the school wants.

Some board members said they thought the lack of interest may be because the firms believed the July 1 deadline was unrealistic.

But member Michael Thomas said he wasn't so sure. He said the firms could have given proposals contingent on a later deadline.

"I don't think this is the route we even need to take," he said. "I don't think we're going to get anything of what we envisioned."

Board President Dawn Aubert also questioned hiring a consultant.

"We've had a lot of community engagement," she said. "I'm still wondering what our objective is in this community engagement project... To be honest, I don't know what we're looking for."

Member Tim Albores said residents want the school to sell to a buyer that plans to operate under Willow Springs' current zoning. Previously, the school tried to sell the land for industrial uses, which are barred under zoning.

"Let's sell," Albores said. "Or at least do some surveys and town halls without paying somebody to hold our hand with it, and then sell."

Member Elvia Nava agreed.

"It's a fiscal responsibility that we have to do something with the land that's not being used. Time is money," she said. "I think we need to sell. I would be ready to vote for that."

However, member Jill Beda Daniels said she was uncomfortable selling the property without seeking more public feedback.

"I think it's something that has divided the community," she said. "I would like to hear all of the community speak for it in some way that's concrete before I would be comfortable to vote either way."

She also said many residents may have missed the school's updates on the issue, other than what they've read in Patch. She said it was important to find ways to reach them.

The board took no action on the land at its meeting. Officials are awaiting an appraisal of the land under its current zoning, which allows residential and small retailing uses. It is expected soon.

But one board member on Tuesday advised his colleagues to keep the focus on the property. He said the school needs the proceeds from a sale because it lacks the money to complete construction projects.

Last month, the school board received the bad news that the bids for its projects were much higher than expected.

At Tuesday's board meeting, board members said they wanted to halt the conversations about the 70 acres of wooded land until they have a full board. Earlier in the day, board President Dawn Aubert abruptly resigned, saying she was moving out of state.

Board members Kari Dillon and Jill Beda Daniels said the board was "in flux" and needed to focus on the issues before it, namely the planned construction projects.

"We have a lot going on where we're at with all the new things happening," said Daniels, who was connected by phone to the meeting.

Member Tim Albores said the board had no urgency to take action on the Willow Springs property.

But member Michael Thomas disagreed. He said there was urgency because the board lacked the money to complete projects.

Superintendent Brian Waterman seemed to agree, saying the school's architect wants to have conversations on the coming projects in the next couple of months.

Jill Grech, who became board president upon Aubert's departure, said she wanted certainty with the Willow Springs land. Member Elvia Nava was the only member who did not weigh in.

Grech and the others concluded that they should wait until they appoint a new member. The deadline for applications is April 19.

Early last year, residents in Willow Springs and nearby towns became upset when word leaked that the school was trying to sell to an industrial user, although zoning bars such uses. The land is next to houses and Pleasantdale Elementary School.

Willow Springs resident Fred Whiting told the board Tuesday that it should apologize for trying to turn the land into "an industrial dumping ground."

"It was one of the most disrespectful things you could do to a feeder (school) district. And you sit there as if nothing happened and time will dissolve it. It won't," Whiting said.

In previous meetings, board members said it was important to get an appraisal on the land for allowed uses, which are mainly residential.

The school received the document last month, but denied Patch's request to see it.

"The whole community has anticipated the results of the appraisal, and for some reason, it's being stonewalled to provide that to the community," Whiting said.

Under its policy, the board does not respond to public comments.
