What’s on the menu: This year’s Thanksgiving menu features fully prepared family dinners with either a six-pound herb-roasted turkey breast or a six-pound smoked ham, homemade cranberry sauce, mashed potatoes, cornbread stuffing, and green bean casserole. When the Ocean View Town Council met this month, the council chamber was again filled to standing-room-only capacity with those protesting the Town’s new ordinance Chapter 77, also known as “the First Amendment ordinance.”

In its original form, the ordinance established guidelines and a permitting process for assemblies in town parks and on Town-owned property, held under the provisions of the First Amendment. ACLU Delaware subsequently called for its repeal, as did about 17 people gathered at John West Park before the Sept. 9 council meeting. The protestors carried American flags and signs with slogans such as “Free speech 4 all,” “Hands off free speech” and “Our founders knew freedom of speech is meaningless without freedom of assembly.”

In response, the council, at the Tuesday, Oct. 14 meeting, introduced a resolution to repeal the ordinance and replace it with another, titled “Community Activities,” to “protect the First Amendment rights of the citizens of the Town of Ocean View; promote the general health, safety and welfare of the community; ensure there are adequate numbers of Town personnel to maintain public order and traffic control; and establish guidelines under which Community Activities may be held and regulations for competing uses of the Town’s public property.”

It describes a community activity “an expressive activity consisting of a parade, procession, march or assembly consisting of persons, animals, vehicles or any other combination thereof, which is to assemble or travel in unison on any public street, highway, alley, sidewalk or other Town-designated public way which does not comply with normal or usual traffic regulations or controls or one such activity occurring in a Town park or on Town-owned property.”

In the ordinance, “spontaneous activity” is described as “a community activity in reaction to current news or affairs coming into public knowledge less than 48 hours prior to such community activity.”

Under the proposed replacement ordinance, an administrative fee of $25 will be charged, and violations could result in a fine of up to $250.

Before public comments began at this week’s meeting, Town Manager Carol Houck said the new ordinance was only being introduced that day and the council would not respond to any comments about it.

The ordinance is scheduled to be officially introduced for its first reading at the Tuesday, Nov. 18, meeting, and the council could vote on it on its second reading, at the Tuesday, Dec. 9, meeting. (The November council meeting will be on the third Tuesday of the month instead of on the second Tuesday, because Nov. 11 is Veterans Day.)

Among those addressing the council about the ordinance was Cheryl Siskin of Rehoboth Beach, who said the revised ordinance is “a lot less offensive to the Constitution, but there is a provision in there toward the end that says the person who files the permit is responsible for disorderly conduct by other people, but there is nothing in the law that supports that.”

Putting that responsibility on others, “It’s a chilling effect on the First Amendment,” she said.

Sandi Roberts of South Bethany told the council she won’t patronize any businesses or restaurants in Ocean View town limits “as long as this ordinance is in effect, and I will encourage everyone to do the same. … Some actions have financial consequences.”

Another woman said there should be freedom to express opinions and that waving signs on public property is not illegal.

A resident who approached the podium wearing a face mask — prohibited during protests, under the original ordinance — told the council, “You’re not telling me I can’t wear a mask. I’m going to tell you something. I’m going to wear a mask. My brother lost his life to COVID. I’m not losing mine. If I have to get arrested for wearing a mask, so be it. You’re not going to kill me.”

Pam Peterson, a member of Indivisible Southern Delaware, told the council there is no need “for this grave sense of control that has come about by your ordinance.”

Barbara Katz of Bethany Beach said she is “bewildered as to why the Town enacted the ordinance” and said the revised version “still has problems related to restrictions concerning time, money involved and the size of the group.” She said there have been many peaceful demonstrations in Bethany Beach this year that haven’t scared away tourists or damaged property, and another one is planned this weekend.

“I spend a lot of money in Ocean View. I patronize a lot of the businesses here and … I am not going to patronize any of the businesses here while this ordinance is on the books,” she said to applause that began before she had finished speaking.

Another Ocean View resident asked the council to “discontinue the entire ordinance.”

“There is something called freedom of speech and freedom of assembly. I just turned 80, and you are telling me I can’t do it? Well, that’s not American. … Things are going crazy right now. I don’t know if anybody has noticed, but somebody has to say something,” she said.

She said the average age of residents in Ocean View is 65.

“We are not a rabblerouser group,” she said to laughter.

“Totally get rid of the entire thing. Be like Bethany. Be like Rehoboth, and let the 65-plus and -under people — just, please, let us have freedom of speech and freedom of assembly,” she said to cheers.
