PHOENIXVILLE >> The greatness of the Phoenixville Area High School sports program’s tradition came to the forefront once again Wednesday afternoon at Doc Kennedy Field.
Former Cleveland Indians All-Star slugger Andre Thornton, a product of the baseball program from his youth days all the way through to American Legion baseball, returned home from Ohio to have his No. 29 retired by the Phantoms.
The ceremony took place prior to Phoenixville’s Pioneer Athletic Conference Frontier Division contest against Pottsgrove. Phoenixville held on to edge Pottsgrove, 4-3, anchored by the combined stellar pitching work of Matt Osisek-Byrne and Trip Shoemaker.
The Phantoms will close out the regular season of their schedule with a home date against Upper Merion Thursday afternoon in a game that was moved up from Friday due to threatening rainy weather Friday. Phoenixville hopes to close out with another win in order to help solidify its position for a home game in the opening round of the upcoming District 1 5A playoffs.
Like most of his peers in that era, Thornton played all sports year-round in Phoenixville, going from football to basketball and then to baseball in the spring and summer. His many friends and teammates followed suit and also participated in some other sports as well.
Andre’s older brother, Bill, remains active in Phoenixville athletics. Bill currently serves as an assistant baseball coach under second-year head coach Neil Herman, a former assistant coach at West Chester University and Sun Valley High School.
Phoenixville honored Andre Thornton for his overall achievements in life, not solely as a baseball player. He was honored as a husband, father, current CEO of ASW Global in Ohio, community leader, ballplayer and forever a Phoenixville Phantom.
Andre enjoyed a 14-year career in the major leagues. He was originally signed as a free agent by the Philadelphia Phillies in 1967, but he subsequently moved on to the Atlanta Braves in a trade. From there, he headed to the Chicago Cubs (three years), Montreal Expos (one-plus years) and finally the Cleveland Indians for the final 11 seasons of his professional career.
The two-time American League All-Star belted 253 home runs during his major league career, finishing in the top five in homers three times in the American League.
He was presented with the Roberto Clemente award in 1979 for his sportsmanship and community involvement. Later, he was given the key to Phoenixville on Andre Thornton Day in 1982.
Andre was impressed by the big expansion that has taken place around Phoenixville in terms of the schools and athletic facilities.
“It’s always fun and an honor to come back to your high school once you see what you’ve done and what you accomplished,” said Thornton. “It is a fun day. I am real pleased to do it.”
His high school head coach was the late Paul Tomko. His American Legion manager was the late Samuel “Nebs” Griffith, who took him for his original tryout with the Phils.
However, longtime Phoenixville baseball coach John “Doc” Kennedy was on hand to see the Thornton festivities Wednesday. Kennedy coached Thornton during his Phoenixville Babe Ruth League all-star championship years. Thornton said the late Chester Miller and Frances McElroy were other coaches who were instrumental in his career.

In the Phantoms’ victory, Osisek-Byrne pitched the first 5 2/3 innings for the victory with Shoemaker coming in from the outfield to hurl the last 1 1/3 innings. Osisek-Byrne gave up six hits and two runs (none earned) with 11 strikeouts and one walk. Shoemaker allowed one hit and one unearned run with four strikeouts and no walks.
For Pottsgrove, Alex Stump threw the first 4 1/3 innings. He yielded four hits and three earned runs with six strikeouts and five walks. Bailey Delp relieved for 1 2/3 innings with three hits and one earned run, one strikeout and no walks.
Pottsgrove led 2-0 with the Falcons scoring two runs in the second inning. Phoenixville countered with three runs in the fifth and one in the sixth.
Osisek-Byrne ripped a two-run triple to the left-center field gap to tie the game at 2. Zach Masalski contributed a double, triple and one RBI. Luke LeBeau (double), Colton Brown, Shoemaker and Kyle Syrek added hits for the Phantoms.
For the Falcons, Nick DeCurtis finished 3-for-4 with a triple and one run scored while leadoff man Adam Girafalco went 2-for-4 with a pair of doubles and two RBI. Colin Templin and Austin Spencer chipped in with hits for Pottsgrove.
“The game was right there for the taking, but we didn’t get after it,” said Pottsgrove head coach Jamie Nash. “We had no enthusiasm. Our intensity wasn’t there for us today.”
On the other hand, Nash felt Stump and Delp were phenomenal in the pitching department.
Herman was glad to pick up the narrow win.
“Our new philosophy for the rest of the season is survive and advance,” said Herman.
He said while the Phantoms made mistakes, he did not want to dwell on them with another big game in store Thursday.
“O-B pitched really well,” said Herman. “He started out slow, but then he really found it. His curveball was working. He found it in the third or fourth inning, and then he started mowing them down.”
In 2012, General Motors (GM) petitioned the Pennsylvania Department of Revenue Board of Appeals (BOA) for a refund of CNIT paid during the 2001 tax year. During that year, GM had over $200 million in prior year net losses and approximately $9 million in taxable income. In 2001, the NLC deduction was capped at $2 million and did not yet include any percentage limitation.4...

In 2001, the NLC deduction was capped at $2 million and did not yet include any percentage limitation.4 GM argued that the $2 million flat dollar cap resulted in a “progressive effective tax rate” in violation of the Pennsylvania Uniformity Clause.5 The BOA denied GM’s refund request, finding that it did not have the authority to declare statutory provisions unconstitutional. The taxpayer appealed the decision to the Pennsylvania Board of Finance and Revenue (BF&R), which sustained the BOA’s decision also on the grounds that it lacked the authority to rule on the constitutionality of tax statutes. GM then appealed to Pennsylvania Commonwealth Court, which held the case pending the Pennsylvania Supreme Court’s decision in Nextel due to the similarities in issues between the cases.
In 2017, the Pennsylvania Supreme Court decided Nextel, holding that the flat dollar cap contained in the NLC statute as it existed in 2007 violated the Uniformity Clause. During this tax year, taxpayers could deduct the greater of either $3 million or 12.5% of taxable income.6 Nextel challenged both the flat dollar and percentage caps as unconstitutional, and the Pennsylvania Supreme Court agreed as to the flat dollar cap portion. The Court reasoned that the NLC statute violated uniformity because some taxpayers could eliminate their tax burden while similarly situated taxpayers had to pay tax. In fashioning a remedy, the Court severed the flat dollar cap from the remainder of the statute, while preserving the percentage cap portion. The remedy left Nextel in the same financial position because they were still subject to the percentage limitation instead of being allowed an unlimited NLC deduction as it requested.7
After the Nextel decision, the Commonwealth Court issued its opinion in the GM case in November 2019.8 Noting that the parties did not dispute whether the $2 million NLC deduction cap for the 2001 tax year violated the Uniformity Clause under Nextel, the court primarily considered the appropriate remedy to cure the uniformity violation.
First, the court addressed the severability of the NLC statute as applied to the 2001 tax year. The court observed that, unlike the 2007 tax year NLC deduction provision applicable in Nextel, the 2001 tax year NLC provision did not include a percentage-based deduction cap, which the Court had embraced as a remedy in Nextel. The court recognized that the 2001 tax year provisions offered two options for severance: (i) sever the flat $2 million deduction from the remainder of the NLC statute and allow corporations to claim an unlimited net loss; or (ii) strike down the entire NLC provision. Neither of those options met the twin policy objectives of the statute as identified in Nextel: encouraging business investment and maintaining the Commonwealth’s fiscal health. The court then determined that the main purpose of the NLC provision was to promote business investment, observing that the NLC deduction provision had existed during the 1980-1991 tax years without a cap. Accordingly, the court concluded that severing the $2 million flat dollar cap and upholding the remaining portions of the statute would best fulfill the legislature’s intent of enacting the NLC statute.
Rejecting GM’s argument that the flat dollar cap violated the Due Process Clause of the U.S. Constitution, the Commonwealth Court reasoned that the only way to provide meaningful backward-looking relief to remedy an unlawful NLC provision was to sever the flat dollar cap and allow GM to claim an unlimited NLC deduction.9 As a result, the court allowed GM to claim an unlimited NLC deduction for the 2001 tax year, also ruling that the best implementation of Nextel required retroactive application of its holding to prior tax years. After filing exceptions with the Commonwealth Court, the Commonwealth appealed the decision to the Pennsylvania Supreme Court.

The Delaware County Jail Oversight Board continues to hold hybrid public meetings in response to COVID-19 mitigation efforts. Meetings will be recorded live and in-person in the County Council Public Meeting Room with some participants joining remotely. Members of the public can watch the meeting online or attend in person. Residents who wish to attend the meetings in person are required to wear a mask during the meeting.
Public comment will be accepted in person and will no longer be accepted via email and by phone. The Board will livestream its meetings on this web page.
The Delaware County Jail Oversight Board will conduct their monthly meeting at 4:30 PM in the Delaware County Council Meeting Room, Government Center Building, Media, PA on the following dates:

The National Weather Service confirmed a tornado did touch down in Glen Mills, Pennsylvania, during the late-night hours of Halloween.

About two dozen homes in Glen Mills, Pennsylvania, sustained damage.
Neighbors said it sounded like a freight train. A Tornado Warning was issued, minutes before damage was reported in Delaware County and the surrounding areas. Emergency officials credit that warning with having people seek shelter in their basements.
In the Cobblestones at Thornbury community, west of the Glen Mills golf course, on Chelsea Court, a garage was completely ripped apart; trees are down across a number of roads, leading to closures. Other homes have windows blown out and roofs collapsed.
Another family reported a portion of their ceiling came down with sheet rock actually falling into their bed.
"It almost looks like a bomb went off," said NBC10 reporter Randy Gyllenhaal. "They all ducked for cover whether under their beds or in their basements."
There's no official word on whether a tornado touched down or wind caused this damage.
"[There's] significant damage from either straight-line winds or a tornado," Timothy Boyce with Delaware County Emergency Management said.
Emergency crews are spending Friday going door-to-door, making welfare checks, and sending in structural engineers to assess the damage. The American Red Cross set up a shelter to help displaced residents.
No one was seriously injured, according to emergency officials.
A massive tree was also uprooted in nearby Thornbury Court, where there's no visible signs of homes sustaining damage.
Tens of thousands of people in southeastern Pennsylvania are without power while just a handful of customers in New Castle County are in the dark.
A tree also came down on a vehicle on Thompsons Bridge Road, north of the Brandywine. That road will remain closed.

But in Wolf’s case, this year stands out for a reason other than a global pandemic.
“I’m in my sixth year and this is the deepest team I’ve had,” Wolf said Thursday. “You usually don’t have four very good lines at high school, and I have four very good lines.”
The Ches-Mont League’s National Division in the Inter County Scholastic Hockey League dropped the puck on January 8, and most teams are now more than a month into their seasons. Reigning league champ West Chester East (4-0-0-0) is still the team to beat. But it’s that unparalleled team depth that is causing the rest of the league to worry.
The first-place Vikings put a stamp on the standings Monday with a 6-1 victory over crosstown rival Henderson, keeping their winning streak alive. Although the atmosphere at Ice Line wasn’t the same as a usual rivalry game, there was no lack of competition.
The Vikings dominated on the offensive end, compiling more than 40 shots on goal. The attack was led by sophomore Greg Diamond, who scored half of the team’s six goals, ending the night with a hat trick.
It’s Diamond’s first year on the East roster after playing his freshman season at Cardinal O’Hara, but he is already complementing the skills of upperclassmen on the offensive end. Senior Tristan D’Elia has been a playmaker alongside Diamond, tallying three assists on Monday, bumping him up to a total of 15 on the season.
On the other end of the ice, West Chester East is without its best defenseman, senior Michael Cardarelli, due to a knee injury. That leaves it up to underclassmen like sophomore Henry Thornton to protect the net in front of goaltenders Jake Godshall (four starts) and Connor McBridge (three starts).
“Henry Thornton might be the best defender in the Ches-Mont right now,” Wolf said. “He’s a sophomore, but he doesn’t play at a sophomore level. He controls, he goes against the other teams’ best players, he’s at the top of our first power play unit. If there’s a matchup we want against another team’s guy, he’s the first one over the wall. He takes care of business.”
West Chester East will try to protect its win streak against Avon Grove (1-1-1-0) at 9:45 Friday night at Ice Line. A win against the Red Devils would be a step toward the team’s very specific goals per Coach Wolf: secure a first-round bye in the Ches-Mont playoffs, win the league championship again, get the No. 1 seed in the Flyers Cup, win the Flyers Cup, and win the state championship.
The Vikings are off to a great start.
The undefeated girls from West Chester Henderson sit atop the American Division standings thanks to a perfect 8-0 start. Freshman Kayla Czukoski has been an offensive force on the ice, recording a staggering 16 goals and nine assists in just seven games played.
Czukoski is not the only underclassman making a statement. In the National Division, the girls from Downingtown East/Bishop Shanahan (3-4-0-0) picked up a solid win Sunday against Pennridge (1-3-0-1). They were keyed by a standout effort from two sophomores — goalie Olivia Ceglia and forward Maggie Jacoby — en route to a decisive 7-0 win. Ceglia recorded her second shutout of the season and Jacoby took over on the offensive end, scoring four goals on the day.
Back to the boys side, Malvern Prep (4-0-0-0) and Holy Ghost Prep’s (3-0-0-1) undefeated records were put to the test in an overtime Atlantic Prep Athletic Conference (APAC) matchup on Wednesday.
Each team stepped onto the ice with a spotless 3-0 record, but only Malvern left without a scratch, notching a 3-2 shootout win.
The teams’ stat lines were nearly identical, with each recording 28 saves and exactly 30 shots on goal.
The third period ended with the game tied, 2-2, and the overtime period came and went, with no goals from either team, leaving their undefeated records in the hands of a shootout. After two attempts from his teammates, it was senior Jack Costabile who decided the game with a goal.
Even though Costabile made the game-winner, he attributed the win to his teammate in the net, junior goalie Anthony Perti.
“Perti kept us in the whole game,” Costabile said. “We have a lot to work on, but a good overall team win.”
The saga isn’t over just yet. Holy Ghost Prep will get the chance to avenge the loss when Malvern heads north to Grundy Arena on Monday.
It’s rivalry week in Downingtown again, and, as always, the boys’ showdown between East and West Friday night at Ice Line is one to watch.
It’s the second meeting between the teams this season, and the Cougars (1-2-0-1) will hit the ice with a vengeance after a tough overtime loss in January.
Junior Trent Thomas scored an impressive hat trick for the Whippets in his team’s 4-3 win last month, but he hasn’t found the back of the net since.
The Cougars’ foremost offensive asset, Mark Stankiewicz, is the player to watch. The senior scored two of the Cougars’ three goals against West, and so far this season he has recorded eight goals and added four assists in five games played.
